Park With Ease Response

I received a Parking Charge - Notice to Keeper from Park With Ease on 1st July 2019 (dated 26th June 2019) for a Period of Parking on 19th June 2019 16:07:39 - 16:18:28 (just under 11 minutes). I did not get a window ticket.

I had not realised that this was an ANPR car park or indeed even a Pay and Display Car Park. My daughter was working there (agency placement) and finished late (due to finish at 16:00). I hadn't got out of the car so had not considered the signs. The letter came as a shock.

I don't want to contact the place that she was working about this as don't want to rock the boat for her. She hopes that the agency will send her there again.

I sent the recommended template, by email and, within hours, got the following response (below).

I am not sure whether to respond or to just pay the £30 (which I can ill afford and is nearly as much as my daughter earned that day).

I did try searching the FAQ thread and the forum but without success.

Email from PWE:

Thank you for your email

Upon entering the site you entered into a contract to pay for the parking that was due at the time or up to 48 hours following your departure (online) or pay a parking charge notice (reduced if paid within 14 days).

The signage on site clearly states that charges are in place 24 hours a day on all days and apply to all vehicles. There are 3 signs on this site, including 1 on the entry, 1 on the exit and one by the kiosk. Our signage has been audited by The IPC our Accredited Trade Association and is fully compliant.

We have invited you to inform us who the driver at the time was. We do have images of the vehicle entering the site and should we need to we may choose to get the images enhanced in order to present them as evidence in court should you choose to allow the matter get that far.

Since you failed to pay for the parking that was due at the time or up to 48 hours following your departure and were over the advertised grace period of 10 minutes the parking charge notice has been issued correctly.

You can pay your parking charge notice online at www.parkwithease.co.uk or by sending a cheque or postal order to Park With Ease, Unit 15 Duttons Business Park, Dock Road, Northwich, Cheshire, CW9 5HJ.

The Independent Appeals Service (www.theIAS.org) provides an Alternative Dispute Resolution scheme for disputes of this type. As you have complied with our internal appeals procedure you may use, and we will engage with, the IAS Standard Appeals Service providing you lodge an appeal to them within 21 days of this rejection.

If you believe this decision is incorrect, you are entitled to appeal to the Independent Appeals Service (IAS). In order to appeal the IAS will need your parking charge number, your vehicle registration and the date the charge was originally issued.

Please note, the 14 day reduced period is not held whilst an appeal is in place.

It is an IPC affiliated company and so pointless appealing further, all you can do now is sit and wait to see if the PPC issues a LBC and proceeds to a court claim. They have 6 years to do this but in the meantime they will bombard you with debt collector letters (which you ignore. You can also go to the NEWBIE sticky to read up about the situation in which you find yourself, along with advice about debt collector, court claims and acronyms.

Whilst I appreciate what you've said - I'd strongly suggest that it is taken up with the employer if they are the ones employing theses scammers (especially if the reason you've received the ticket is because she was asked to stay late).

Agreed. It's pointless going back to work there if the entire days pay has to be given back.

Thank you for the replies. I haven't told my daughter as don't want her to feel bad. I am such a wimp. I don't know that I've got the courage to ignore debt collection letters. I also, have to be enhanced vetted, as part of my job and would need to declare them. I think I might just have to suck it up and pay it. So mad, mainly with myself.

Debt collectors have no powers to do anything except send poor quality bog paper. There is nothing on this planet that would require you to tell anyone you have received begging letters.

With all due respect this is - unfortunately - a part of every day life for us and our kids. We cannot protect them in a bubble for their entire lives, and ultimately they need to be exposed to this type of thing at some point. Consider this a life experience for you both and a challenge for you both to overcome. Why don't you beat this thing together, and show your daughter that she can't be taken for a victim her entire life and teach her how stand her ground?

Due to the nature of my work, I have to declare financial details including debts and debt collection letters etc. It's for security clearance to ensure that I'm not vulnerable to blackmail.

This isn't a debt. It's an invoice requesting payment for an alleged breach of contract.
