After much research I ordered a new car via them in May, to arrive roughly the end of August. In the meantime they have gone into liquidation. They have answered emails promptly saying my order has gone in and is safe as they will introduce me to a dealer directly when the car is available. They have refrained from charging the deposit to my credit card and one of the reasons I chose them in the first place is that they gave good advice about using a credit card for the deposit so that the entire transaction is protected. As far as I can tell, they are a perfectly honourable company whose car sale business has been unfortunately been fatally damaged by trouble with another side of their operations. But has anyone else been in this situation and if so how did it work out?

So have you actually paid anything for the car as yet ? If you paid the deposit - or any amount towards the card - on credit card, then you'll be covered by S75 should the car not arrive. As long as it cost less than £30,000, that is. But you said they've not charged the deposit to your card ? So if you haven't paid anything yet, and the car doesn't materialise, then it's annoying but you're not out of pocket ?0

Correct. I have paid nothing. And it's well under £30,000.0

So what's your concern ? One of two things will happen. Either you get notified that the car is ready for collection - you go to the garage, pay the money and drive the car away. Or the car never turns up, in which case you've lost nothing - apart from a bit of hassle of having to start looking for another one.
The Section 75 protection would come in to play if, say, you paid some money for the car by card in advance, then the company went bust and you were never able to collect the car. But if you've paid no money up front, you've lost nothing if the company fails to deliver the car.0 -
I'm not concerned about losing money. I'm concerned that if the car does not turn up, I will have to wait at least another 14 weeks for one to be built to my spec.0
