    Hi All,

    Just seeking some further advice.

I’m currently waiting for a date from the courts, have not heard anything as of yet for this claim.

Subsequently this week I have received another claim from the same company for a different “fine” This is an official court letter, and CEL have this time sent me particulars of their claim.

Given that I had requested details of all claims and they failed to disclose this via SAR - shall I petition this to be heard at the same hearing, when a date is set for the first claim?

I haven’t looked into the full details of the claim as I have been away this week but will post further details of this second CEL claim and any thing further that may prove useful.

    Thanks

If you can get the timing right and can submit your defence (for this second claim) smartly you should submit a covering letter with it asking for claim No. XXXX (already submitted) and this claim No XXXX to be consolidated as a way of saving the court's valuable time and saving money. You could also download, complete and submit a DQ with the same covering letter and, once you have a court date, send them the same letter and keep sending it until someone (a judge hopefully) notices it and consolidates both cases.

I would mention the lack of clarity/honesty from the claimant by failing to inform you of the claim in answering your SAR (provided they could have known about it at the time of your SAR submission) in the Witness Statement of the second claim.

Agreed, and the wording has already been written for this scenario. Search this forum for:
