Bathstore - Next Steps????

Hi All
I'd really like some advice as I'm a tad confused by the whole situation we find ourselves in with the Bathstore who went into administration last week. In summary:
Products delivered: 17/6 - we believe we have most things but have a few parts missing
Fitters attended - 24 & 26 June (amidst all the rumours of the collapse) and did little more than remove my old showeroom - we now have no downstairs shower room
Total Cost: £12,000 (for 2 bathrooms products and install)
Despoit Paid on Credit Card: £1,200
Buy now pay later Hitachi Finance Agreement: £10,800
Now I am really confused as to who I should claim from and what amount?
- Bathstore shop/administrators have said that if we pay them £2800 for the products they will cancel the finance agreement with Hitachi
- Hitachi have said that they can offer 3 options
1. pay the installers directly for the fitting, credited to the finance agreement to be deducted from the balance owed.
2. get an installer and put it on finance andd the finance agreement would remain unchanged.
3. Hitachi can instruct a remedial company to complete an inspection to confirm what works are required and following this, arrange for works to be completed.
Fortunately I am in a position where I can proceed without the finance and would like to cancel the credit agreement as I dont believe I have received all the goods and definately have not received the install service. Cancelling to agreement with Hitachi is not offered as an option???
- I am still waiting to hear back from the Credit Card on making a claim under Section 75 - but would the full £12,000 covered under this? or another amount?
Even more confusingly the costs dont seem to stack up. Individually the costs since the administration are below (and these dont add up to £12k)
- Bathstore shop/administrators have said that if we pay them £2800 they will cancel the credit agreement (both Hitachi and Credit Card advised not to pay). Do I owe this (or another amount) to Hitachi now instead or can I pay the Bathstore Administrators? Or do I just let the Credit Card deal with it??
- The fitters have said they will come back and fit both bathrooms for the price they were going to be paid for both bathrooms, totalling circa £5000.
Selfishly I'd save alot of money if I did this! But I dont understand where I then stand with the CC or the credit agreement. We only bought from the store so that we had gaurantees and someone to help us through this. Now that is not there we would rather return all the products and not have anything to do with it all - but again this isnt an option as we're told we cant return the products.
If anyone can help guide us through the minefield we would be very grateful!

This needs to be on the consumer board.
You won't get the full amount back if you've got the goods. If you did a Section 75, Bathstore would appeal the goods you'd received.Everything that is supposed to be in heaven is already here on earth.

Hi, can I ask what you did in the end, I have just been contacted by the administrators and they are giving me a 25% reduction if I pay them but am very much aware that my agreement is with Hitachi.0

Apologies, not sure how to start a new thread? I have received a letter from BDO saying that Hitachi have informed the that Bathstore’s company records show that they did not complete the paperwork for the finance agreement before they went into administration. The letter states that Hitachi will therefore ‘automatically and unilaterally cancel the agreement 6 months after the date we entered into it’. This was an agreement whereby we did not pay anything for 12 months. And the 6 months has already past therefore I am assuming the agreement has been cancelled by Hitachi.
BDO are now saying that they themselves will request payment from us in January instead of June (bringing the payment forward by 6 months) and expecting us to pay it in full! Can they do this? In my mind, if there is no paperwork to say we had a financial agreement with Hitachi (because it’s now cancelled) then do we really need to pay it? Legally, would we be in the wrong?
Any help or advice would be much appreciated. There’s no way we can get the money together for January!0
