Section 75 and Jet2 or Tui

Hello,
I appreciate it'll be covered by ATOL, but if I buy a holiday from Jet2 or Tui (I'm undecided which at the minute) are they classed as travel agents and section 75 won't apply or am I buying flights/hotel direct them as the airliner mean I'm covered?

Btw, I'm assuming this is posted in the credit card forum as that is where I am but I keep getting a message saying I'm posting to 'grabbit board and am I sure'

    Depends on what you mean by “covered”. But assuming you mean the following:

    1. You are buying a package holiday (flights + hotel)
    2. Jet 2 or TUI go bust and you don’t provide the service(s)

    Then in this situation your card provider would reimburse you using a chargeback. ATOL “protection” wouldn’t be required in most cases, they would refer you to your card issuer for a refund, which is what happened with Monarch, Jet Airways, and most airlines/travel agents since, well, a very long time ago.

    Section 75 could potentially be used for consequential losses such related to your cancelled holiday, such as excursions, transfers,. So additional costs over and above the actual purchase but related to it.

    But chargebacks would be used to reimburse the flights and accommodation costs.

    I’m guessing your concern is over the use of travel agents and them being considered a 3rd party when s75 is concerned, but this won’t affect a chargeback claim. The example you give of a package holiday scenario is very low risk imo and both merchants are providing the services themselves.

    Where it gets complicated is using a travel agent who then arrange your holiday via a separate airline and hotel. Or when you book everything yourself through different merchants as it’s cheaper. Imo this increase the risk of things going wrong and not getting your money back, but not always.

    Travel insurance would be the last option imo and would require a policy that covered insolvency and of course this isn’t free.

    So, in short, I’d have no concerns about getting your money back after booking using either of these merchants (should they go bust).

    There can often be excesses on travel insurance, do the same excesses apply with chargeback, ATOL or s75?
