Hi,
First of all, sorry for starting yet another thread but really in need of help and undecided on how to deal with a PCN from these people.
I parked in a private car park for under an hour while going for lunch on a sunday. I didn't realise at the time and even paid (still have the ticket) for regular parking thinking it was legit but somehow missed the sign on entering.
What I'm wondering is would my appeal be strong enough with the usual? I've appealed in the past against Parking Eye and won but that was under different circumstances regarding parking time which is a more straightforward thing to fight and appeal against than private car parks. Anyways, if someone could give me any advice it'd be appreciated as I'm letting it bother me on top of other things and running out of the appeal time. I'm aware of the stock response to these PCN's and this can obviously be deleted as soon as it's served its purpose.
Thanks again.

Anyway they are a BPA member so use the template (on day 26 if it was a windscreen PCN).I parked in a private car park for under an hour while going for lunch on a sunday. I didn't realise at the time and even paid (still have the ticket) for regular parking thinking it was legit but somehow missed the sign on entering.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

The alleged contravention was that the car was parked in a private car park that I wasn't a patron or permit holder of.
The PCN was sent through the post so won't be able to do the day 26 response.0 -
If their attention to detail on that website (which also has grammatical errors) is indicative of NPS, then I doubt they've managed to send a POFA-compliant NTK in terms of wording and timeline?
Compare it to para 9 of the POFA and check.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Can you please be more specific about the nature of the alleged breach of contract. Did you pay at the wrong car park?
Nine times out of ten these tickets are scams so complain to your MP.
Parliament is well aware of the MO of these private parking companies, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.
Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

Just as the clampers were finally closed down, so hopefully will many of these Private Parking Companies. You never know how far you can go until you go too far.0 -
Thanks for the reply.
Yeah, I checked it over and everything seems to be present and correct.
There is no addressing of the driver, however.
Just a name of the owner of the vehicle and address on the top left which I presume they've taken from the DVLA.0 -
Thanks for that.
I've ended up using a ticket that should only be used for the parking adjacent to where I parked.
I will put a complaint through but I'm unsure whether appealing would be the best route or to just simply ignore.
I guess what complicates it a little is the fact that I'm due to move in to my new house this week so if there's any future correspondence by post (court proceedings etc) I may miss them.
Thanks again.0 -

Thanks again.
Go online to the post office and set up re-direction ASAP
Don't forget to update your V5 and driving licence as the DVLA love to fine £100. THESE ARE SEPARATE UPDATES0 -
Can you show us both sides of the NTK as it somewhat surprises me you say it meets the statutory wording in para 8 or 9.
PLEASE READ THIS BEFORE YOU TRY TO SHOW US IMAGES:
Newbies can't post working links with under ten posts.
To get around that, host your images of the NTK using Imgur or Dropbox then instead of posting a working link to the URL for the image, change http to hxxp.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Although NPS have a good go at POFA-compliance, there are some flaws in the wording. However, I suspect that your average POPLA assessor will be satisfied that the wording is good enough.0
