Cheque Paid into wrong account

I know this sort of thing has been asked a lot but I am not clear on my situation.

I bank with HSBC. I used their new automated cheque paying in machine. At first I used the ordinary paying in slip but when that rejected I was told to use the second one. I think I was a bit flustered by this point, because I then wrote down the wrong sort code for the account on the paying in slip. I have the receipt of the paying in slip from the machine.

It is now a week later and the cheque has not cleared. I was worried so I have been to the bank this morning who have identified that it was the wrong sort code - that sort code does however exist for one of their other branches. They will look into what has happened. If we assume that there is an identical account number with that sort code, and the money has gone into the wrong account, whose fault is it - mine or theirs?

My understanding is that they empty the machine and review the cheques. The cheque came from a company and the name was printed clearly on to the cheque. I thought that it could only go into the account payees name, not somebody elses?

    Chances are its in the middle of working its way back to you.

    You can pay in another name, we get paid our cheques as our trading name not our company name which is what the bank have on file. Theyve rejected some and sent them back and theyve accepted some as they where with the 'wrong' name.

    If its gone to the wrong account and you put the sort code on it then its your fault. Any checks that shouldbe made are contributory but without putting the wrong sort code in the first place it wouldnt have happened.

    Either way its a wrongful credit. You tell the bank, they get in touch with the account holder and ask if its a mistake, they (Account holder) agree and the money is refunded. They disagree (account holder) and the money isnt refunded, you then look at court action to recover it. You should get the money/cheque back.

    So I don't know what *actually* happened in terms of whether another account got credited, but HSBC have located the cheque, and have said that they are now crediting the correct account. Thanks for the responses. Panic over!
