NCP - PCN over 28 days to arrive

As the keeper I received a PCN letter in the post from NCP about a week ago, this is their first form of communication, no ticket left, and it relies on APNR evidence. I have read the Beginners page and several threads but would appreciate some guidance on whether to include all the blue text from the Appeal template or just outline the events as below and point out failure to comply with Pofa 9(4) and 9(5)?

Two attempts were made to purchase a ticket, vehicle details were entered but it wouldn't process the credit card, no error, just returned to the first welcome page. A call was made to their Customer Centre to see if payment had been taken, they advised no. Due to delays, they were asked if ok to leave, they said ok if not been there more than 10 minutes, they were told didn't think it was over 10 minutes but not sure. They did not advise what to do if it was over 10 minutes or advise that there was a possibility of a PCN being issued.

On the PCN it states the Incident date is 22/05/2019, and the date of sending this notice is 21/06/2019
The APNR entry time and exit time show the car was onsite for just over 16 minutes.

While entering an appeal on the NCP website should it use all the blue text from your appeal template, or is it best to provide the list of events as above, and only refer to the late arrival of the PCN?

    Just send the appeal as is, no modifications, additions or deletions. This will likely be rejected but they should supply a POPLA code which is where you can tell your story.

    Is it a leased or company car? A month to send an ANPR camera NTK is odd.
    PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

  • Thank you for the replies. Are NCP unlikely to accept an appeal detailing the events on the day?
    So the recommendation is to only include the blue appeal text with nothing else, and then take it to Popla?

    The car is privately owned and has been for almost 10 years, and on the NTK it states Date of Incident 22/05/2019, Date of sending this Notice 21/06/2019. There is no mention of any previous notice or letter being sent out.

    You could submit the most logical of appeals, but the PPC will reject it regardless in the hope you pay up. Follow the advice given.

    Nine times out of ten these tickets are scams so complain to your MP.

    Parliament is well aware of the MO of these private parking companies, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.

    Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

    Just as the clampers were finally closed down, so hopefully will many of these Private Parking Companies.
    You never know how far you can go until you go too far.

    It is thought that PPC,s do not read appeals, so what is said is largely irrelevant

    We advise you to use the blue text template to get a popla code and kill it off at popla, ignore the advice at your peril

    Thank you again for your replies and time. Submitted the NCP online appeal, (as the keeper) using only the content from your blue appeal template, and no other comments or details. Will wait for the Popla code and start work on the Popla appeal but going to have a break from it tonight!

    Edit: Automatic email received from NCP Appeal site advising appeal received, case placed on hold and they aim to respond within 14 days.
  • Received a letter back from NCP a few days ago in reply to the appeal submitted on their website. Within their short reply they advised "having considered the content of your letter this notice has been cancelled." No other details given, possibly they checked their records and realised the machines were not working, and the PCN was late.

    Thank you to the people here who helped with answering several questions, and providing advice. Good luck to everyone else challenging PCNs.
