    ok thanks I am speaking to Paypal tomorrow so i will try and make a complaint about it, and you are correct, I have a negative paypal balance but have't actually lost any money as yet. I am not sure how they will go about collecting it, I am determined not to pay.

    You won't need to, they will chase you and have letters sent with all kinds of threats but it will eventually go away as they won't take it to court. They had no right refunding the buyer without first getting an input from you. You have done nothing wrong so even if they did break the mould and sue they would lose.


    On the negative side you and anyone in your household or linked to you will lose their Paypal accounts.

    It was insured against loss or damage, but as it was delivered you are right - they don't need to do anything.
    Why would they if it was delivered?

    PayPal have clear time frames and email out reminders and warnings. If a seller ignores the open case they will not keep it open indefinitely . If you opened a case in PayPal for an INR and seller never responded wouldn't you want your money back ? However if the tracking was uploaded onto PayPal when sent then I think seller would have a right to appeal as it could be argued that they had complied with all the requirements for seller protection and had no need to add anything further to an open case.

    thanks for that, has cheered me up immensely. I don't care about not using paypal again, I wouldn't use either them or ebay ever again after this experience. I have emailed a massive complaint letter to their customer support team and attached screenshots of all the evidence. Hopefully they will realise they are not getting their money back. Sorry, my money.

    to be blunt. This is an issue that could have easily been sorted had you been on top of emails/paypal.
    Proof of delivery would have covered it.
    to flip it around. imagine being a buyer who hasnt received their goods and they lose their money because the seller hasn't responded.

    Yes I understand that. But Paypal's policies are not legally binding in law, where it really matters.


    Their internal procedures gives an automatic refund to the buyer, fair enough. But that doesn't mean the buyer was entitled to one, which the seller have evidence they weren't.


    It's only the courts than can decide on this evidence. So that's why Paypal will never take it to court, they will never risk losing a claim like this and setting a precedent for future cases.

    How would PayPal know buyer wasn't entitled to a refund, as per the OP they had never responded to the case ? If seller had shown tracking that proved delivery then they would have won, and as above they allow 8 days to do so- PayPal cannot wait indefinitely for a seller to,respond as that would make a really bad loophole that could be exploited.
