One in the eye for Parking Eye

Having lost both parents in Barnet Hospital some years ago I was in horror at having to go back some 8 years later for my sister. I Paid my £3 for 3 hours but over stayed by 42 minutes not knowing the need to purchase a top-up ticked on that first visit. I did subsequently cotton on.
So I duly received a £100 Parching Charge and immediately appealed using useful tips here. Not unexpectedly my appeal to Parking Eye was promptly refused so I appealed to POPLA. I included the following statement '...Parking Eye has no evidence the driver intended to avoid payment as per the for the three hours paid for and is willing to pay the excess parking fee but no more. Furthermore I would challenge Parking Eye in Court to demonstrate any meaningful loss in this situation..."
I was willing to go all the way to court on principal, but I received a message from POPLA that Parking Eye had declined to contest the appeal, followed a few days later from Parking Eye confirming the removal of the charge.
I appreciate this won't help all but for those of you who paid but overstayed a little and did not realist you needed to top-up I hope my experience is of some help. The message is don't let these scum companies in cahoots with what should be a public service, get away with this highway robbery. All the best to everyone in the same position. Dave

Well done on shaking off PE. I have to say that I'm surprised they dropped their case against you as Barnet Hospital is one site where they aggressively pursue 'infringements'.
Personally, I don't think it was the highlighted statement above that rocked them.
But, a win is a win and you've got one big monkey off your back.Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

But, a win is a win and you've got one big monkey off your back.I don't know what caused them to drop the charge. My specific situation is the reason I posted - to help others and I hope it does. I strongly suspect that they go after the low hanging fruit - suckers who pay up for a quiet life.0 -
I would follow this up with a complaint to the hospital, starting what you said ( ads exaggerating on it) in your opening post, reference in the NHS parking principles.
And also complain to your MP.
You could also submit an FOI request to the hospital, asking how much do they pay parking eye to manage the car park, and what percentage of the money from standard parking rates does the hospital keep, and what percentage of parking charge notice income dues the hospital keep..
If the sole income source for parking eye is parking charge notiCes, then that's a breach of the NHS parking principles, and a further complaint to your MP, and the NHS trustFrom the Plain Language Commission:

Sounds like P/Eye were too busy and dropped a few POPLA appeals unchallenged, as a sentence about 'no loss' was never going to worry them and would have lost in court/at POPLA.
