Fine for parking in free car park, need advice?

    the BARRY BEAVIS case put an end to overstaying on a free car park by more than a certain period, called the grace period, see the IPC CoP in your case as its an IPC company called VCS who issued the INVOICE

    yes VCS definitely take people to civil court, all the time

    VCS wont care what is in your appeal, they will reject it, as will the IAS if using them for ADR , its a foregone conclusion in 2 rigged ballots by 2 kangaroo courts

    you have zero chance of appealing this and getting this INVOICE (not fine) cancelled

    nobody can tell you your chances in court, but it is likely that VCS will cite the Beavis case where he lost 3 times in 3 different courts for an overstay on a free car park which had no facility to purchase extra time

    You have not received a fine.

    The NEWBIES that you say you have read tells you not to reveal the identity of the driver, but you have done so in your opening post.
    Edit it NOW and only ever refer to The Driver and The Keeper, who ae two different people. ;)

    Once you have done that, send the initial appeal template in blue text from post 1 of the NEWBIES, which again, you say you have read. Send it unaltered from the keeper.

    you have provided a WITNESS STATEMENT for the claimant to take a screenshot and put into evidence for a judge to make a slam dunk decision in their favour

  • I see the template in the 1st post of the newbies post (listed just under "Template appeal for BPA or IPC members"?)

    So in this hypothetical case above, I'd just want include this template only?
    No other writing or evidence in addition?

    Also, is it not some kind of offence to not disclose who the driver is?
    And what would you do if it were the driver who was wanting to file the appeal, rather than the keeper?

    a KEEPER has protections like POFA ,a driver does not , hence why we advise that the drivers details are not revealed , why help the opposition ?

    use whatever you like to appeal , they wont budge or cancel, its not in their profit expectations and financial records to do so, the whole point of the car park is that its a trap for the unwary who do not read signs and so fall foul of their rules, allowing them to inflate the charge from zero to £100 , like the BEAVIS case

    that is their business model

    its like those angler fish that stick out a lure to attract the victim in and devour them

    appeal or not, there is no way out of this, other than hope they do not issue an MCOL within 6 years , any appeal will be rejected - period

    Absolutely yes, and the appeal will not work - but looks better than ignoring it. Don't go appealing as driver.

    This is the same as any VCS case, so no need for individual advice yet. Come back at court defence stage.

    There has been a similar case to this which won at court. I would check with the cinema to see if they have any connection with the car park. This must have happened to other people if the cinema has no car park.
