I'd also like to know why the direct appeal with PE was thrown out yet two weeks later they decide not to contest the POPLA appeal.
Whats changed there then?
It's as though they're free to make it up as they go along.
What changed was that they were rumbled. It was a baseless PCN that would have proceeded all the way to the bank had there been no appropriate intervention. Sheer opportunism.
And as others have said it's not the BPA that gets the credit here, it's you / this forum.
Frankly you're highly unlikely to get compensation unless you commence quite a campaign ... I think you might get a lot of support if you did though.0 -
It is of course open to you to bill PE for the time you have spent on this charge, the court approved rate for litigants in person is £19 an hour, plus travel, stationery, postage etc.
Then, when they have rejected or ignored the invoice, up the ante, take them to court. Providing you keep the claim reasonable there is no reason imo why a judge should not look favourably on it.
IMO, the only worthwhile complaint would be to your MP, the BPA are largely funded by PE, so will do all they can to support their paymaster.
Is there some sort of generic letter on this site i could send to Parking eye regarding this.
i would love to bill them, much the same they did to me.
May i add my thanks to you all for your help.
This site is absolute gold for the war on this disgraceful industry0 -
Just send them an invoice for time spent in dealing with an unreasonable PCN. Warn them that if payment is not forthcoming within 14 days you may take legal action.
Here is a copy of a letter before action.
