Complicated PPI payment.

I signed up online for a PPI claims management company, I only ever signed docs online, not actually real paperwork (someone mentioned this may be relevant) and they shortly afterward sent my a letter saying that it looks like I might have had PPI with Santander on a loan current 2000 - 2004 but that it was too small of an amount for them to pursue. They said it may be something I want to pursue directly. I’ve not got around to doing anything about it myself.

On Friday I got a letter direct from Santander saying they’re making me a payment. I signed their acceptance form and sent it back.

I owe Santander from a different loan from 2008 and I have a payment plan for that. I’m pretty sure they’ll offset the PPI payment to that?

The difficulty is that the claims company are already chasing their cut of the payment. If the payment is offset then I am going to be unable to pay the percentage to the claims company. Are they still entitled to it if it’s offset? Are they actually entitled to it as they said they weren’t pursuing? My main concern is that they’re chasing for money I might not ever have in my hand as I am in financial difficulty already. Any advice really appreciated.

    They are entitled to offset and the claims company entitled to their cut for the 'work' they have done so you may well end up out of pocket.

    Did any of the online stuff you completed not ask if you had loans etc written off ? (or did you not read)

    When you are sure (absolutely certain) that there were no questions asked about arrears or defaults etc, you can complain to the Ombudsman. However, Claim Companies are now fully regulated and I suspect you may not have informed the Company that you had outstanding debt with Santander. If you had told them they would/should have refused your custom..

    Do you have this in writing? If you do, send it to them and show them they weren't interested in it.
