Thanks all, I'm going to find out who owns the land and try to contact them to get it cancelled. I have about 10 days left of their 30 day reply, is there anything else I should go back to them with/for?
If it goes to court and I lost, what would be the likely charge - would it be the £100 original fine or would it include any additional costs for court (£25 + whatever else gets added)? I'm thinking if it's going to add up to about £160 anyway, is it worth just paying? My husband will be moving to the UK soon from the USA and we're stressed enough having to manage that without this as well.0 -
This:is there anything else I should go back to them with/for?
The PCN will be for their well known machine failure to record the first digit of the VRN, as discussed in several HX theads that I hope by now you've read. It is obvious to me this is why a PCN was issued because this is what most HX threads are about.A SAR that includes redacted let records should get the details for you to check payment and VRM details around the time a ticket was issued
They have crap machines at some sites. Search the forum.
They are not allowed to pursue a case for a SINGLE digit keying error, so your SAR needs to ask for the data held regarding the payment made for a near-miss VRN (or if you have two cars, provide a scan of the V5C for that second car and ask if the driver paid for that car by mistake and if so, you want to see the data held by the machine.
Have you sent a SAR yet, have you asked specifically about a keying error and why they are pursuing it, given the IPC says they must not pursue simple one digit errors? You need to flush out what this PCN is actually about, exactly.
Yep about £160 but it would be madness to pay this. We win 99% of cases here.If it goes to court and I lost, what would be the likely charge - would it be the £100 original fine or would it include any additional costs for court (£25 + whatever else gets added)? I'm thinking if it's going to add up to about £160 anyway,
Beat the scam and make yourself and your family proud. It's a good feeling to fight these, you know!PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Thanks Coupon-mad. I have requested an SAR and they have provided details just for the vehicle in question, however all that states is the time period for the ticket issued, but does not specify the money entered for that ticket to be purchased.
This isn't a VRN issue, it is for overstay of minutes so there isn't really a relation with the other threads where incorrect VRN were recorded resulting in PCNs (though I have read a lot of these and it seems they do have a number of issues with their machines. The issue here is that I believe the driver entered the correct money into the machine, as did others in the group, but the ticket didn't cover the period they believed had been paid for. I can't find any information or record of the money taken by the machine though. I know it's for them to prove the charge is justified and correct, but surely if it's the driver/keepers word against theirs, they have have evidence of a car being there longer than the printed ticket allowed so would they not just judge in their favour? They use Zatpark for their PCN ticketing and it looks more like a PCN log than a PDT machine read out... it shows the information about the PCN including separate items for a charge of £100 and debt recover costs of £60, which I believe they're not technically allowed to force you to pay as they can't make you pay more than the parking charge £100 - abuse of process point and documented on their own system.
I think I'm going to go back to them and re-request the agreement that says they have the authority to issue charges and pursue them even for first time offenders. I will also request actual ticket data from the PDT machine to see if there is information about money entered into the machine.0 -
SAR to ZATPARK then , to get PDT details
SAR back to HX for redacted PDT details eitehr side of the event
they wont give you the agreement to issue charges because its not your own data
a SAR covers your own data, nothing else0
