New engagement ring - diamond has fell out!

This is my 1st ever post and i'm looking for advice after a sleepless night. I was proposed to in April this year and presented with a lovely platinum ring with 5 diamonds set in (from Green & Benz). Yesterday I looked at my ring and saw a diamond was missing...cue 3 hours of scrambling around on the floor looking for it, to no avail.
My receipt says the ring "is designed to last a lifetime's wear". I wanted to seek advice before i contact Green & Benz as I'm not sure of my rights and I'm not very assertive. If they repair it will they fit a replacement diamond? Ideally I'd like to get a refund and choose another ring from elsewhere, otherwise I'll be afraid to wear it in case more diamonds fall out in the future! I imagine Green & Benz will be less likely to do anything about a missing diamond in 10 years time.

  • They will be able to determine whether the ring was faulty or damaged, although if the diamond has been there for 5 months without falling out they will likely find it to be damaged.

    Best thing to do is go and speak to them, as far as im aware they only have to repair or replace they are not obliged to give a refund. However the company policy may differ to that.

    Take it back and argue that the stone should not have just fallen out, therefore ring is at fault and they should fit a new stone free of charge.

    Perhaps OH has reciept with terms and conditions which might go in your favour anyway. But in the event they do not offer free repair, ask them for a repair quote, then once you have your repair quote write letter, saying you believe you are protected as a consumer under the Sale of goods Act, and that you ask them to reconsider a repair free of charge.

    Then you will have to go down the small claims court route. Your local trading standards or CABureau should help you with the process.

    You are free to choose whether to go ahead with the repair and pay for it, and recover your costs later, or claim for the repair costs in court and then have it repaired. Might aswell pay for it up front IMO. Unless you want to consider asking a third party Jeweller to give you his/her opinion on why the stone might have fallen out and a quote for a repair from him.
