    Bit of a delay as they didn't get back to me the first time. The online conveyancer has changed hands and now accessed my documents and confirmed that no I didn't pay stamp duty the first time on my £62k share.


    I am a bit puzzled as I was never given the option and the sales person I spoke to suggests I check with their legal team if unsure about anything. he said he has never heard of stamp duty being paid on such a low amount.. does this sound wrong?

    Is the onus on the purchaser, or the purchaser's solicitor, to fill in the stamp duty form? It isn't clear on the website - I even am worried that my original share purchase might not have been registered with them - or would this not have been possible ie to purchase without HMRC being informed?

    The responsibility for the return mainly lies with the taxpayer, though in practice the solicitor will normally fill in the return for the buyer to check and sign. Almost inevitably for a purchase for over £40k to be registered with the Land Registry requires a return to be filed. Have you got hold of a copy of the lease and of the registered title yet? You can get them from the Land Registry yourself if necessary.
  • Yes SDLT Geek, I do have a copy of the lease. I'll have a look through my other papers. I did notice that the sale hasn't been registered eg when searching the property on Zoopla etc last sale is showing as years before..
  • I've found the document, the purchase is registered with the Land Registry.


    I just don't think I was asked about market value election at the time, but hopefully this won't be a major expense anyway.


    My neighbour has put his on the market and lowered the asking price to £210k - almost identical to mine. So share I will be purchasing is 60% of this.
