CCJ from ANPR camera at KFC

Hi all,

Yesterday I got a notification on Clear Score, saying that a £290 CCJ is to be applied to my account next month.

Today, I've called the County Court Business Centre and all that's been able to send me is a jumbled email stating that I owe around £183 for parking for 1hr43 at a KFC in Birmingham at the end of August last year. The address is my previous address, so I'm guessing that correspondence was sent there. I changed my address with the DVLA within days of moving to my new address in September.

Since September, they've made no effort to send information or requests for payment to my new address.

Does anyone have any advice? Should I just pay the raised £290 within a month to get the CCJ removed? Or, should I dispute it on the grounds that they could have discovered my new address any time after the three weeks between me parking in KFC and changing my address with the DVLA?

    So they sent it to the correct address for the keeper, as of the date of the alleged incident?

    They don't need to. They sent it to the right address. Making sure your post reaches you is your problem. Royal Mail redirection is easy and cheap.

    Sadly, due to you not getting your post redirected, it might be easier to pay it as long as that's within 30 days of the judgment by default.

    The alternative is to apply to 'set aside' the CCJ (as per the NEWBIES thread section about set asides). But it costs £255 in court fees and you might not get that sum awarded back to you, given the fact that the Claimant had the right address in August, so it's hard to argue they should have known you'd moved house, two weeks later.

    So the 4 minutes or so that it took to drive in and park and read the signs, plus the 9 minutes grace period to drive out after the parking licence expired, is all within the CoP grace periods, so this was always defendable.

    Shame you didn't get your post. I wonder what other important letters went astray?

    Given you never responded to any post, they had no confirmation the address in use was correct

    WHen was the court claim issued? I presume end May this year? Thats 8 or 9 months gap - plenty of time for them to have used TRACE services to confirm the address was good.

    Pretty sure if it gets returned to sender, in the case of Northampton, it is deemed not have been served?
    Private Parking Tickets - Make sure you put your Subject Access Request in after 25th May 2018 - It's free & ask for everything, don't forget the DVLA :D

    Only if it is within the deadlines set by the court (usually 1 month after judgment). If it's outside of that timeline, paying now is not necessarily your first option - it will not remove the CCJ, your credit rating will still remain trashed for 6 years, you will be no better off and you will be 'down' a couple of hundred quid.

    If you are outside of the deadline, there are potentially different options open to you. Check your dates.

    If you do pay it make sure you get verifiable proof of paying. The court will want evidence it's paid and not just take your word for it.
