                    Hi all,
I've read the newbe thread and can't really find anything specific to this so apologies if it's been answered before!
December 2017 I parked at a SIP car park in Bradford while the GF and I went to the Alambra. I got the GF to pay at the pay and display, presented the ticket, etc. A couple of weeks later I received a letter issuing a fine which I promptly ignored (my info on ignoring these seems out of date now from what I read). I ignored another letter or two and have just received County Court notice that obviously doesn't want to get left ignored.
My guess at what happened is either the machine was faulty, or my GF entered my reg wrong in the machine. The parking was around £2.00 for 12 hours so no fears of overstaying paid time etc. Problem is, I paid in cash and don't have the ticket so don't have any way of proving I paid.
Any advice or precedence would be very appreciated as they're claiming £185.00 now and obviously I need to contest this.
Thanks,
Nathan

Could be either. Have you checked to see if the PPC has form? You never know how far you can go until you go too far.0

Who issued the county court claim, a solicitor or SIP
The ticket amount is £100 and you do not owe £185, this is a blatant scam.
Any amount added above the parking charge is Abuse of Process

If SIP have a fully accountable system, they would know they had a surplus of money that day which did not tie up with VRN's
At this stage, you must make the court fully aware of this and in particular ABUSE OF PROCESS0 -
They sent photos of my car coming and going at the right times. Thought the notice was fake at first as it does look like a document that's been made on MS paint, but I've logged in to the .gov site and it is a real claim. Claimant is SIP parking Ltd, under the name Haseeb Anwar.0

Apparently, there is a £100 fine, £60 of damages, and £25 court fee to total the £185. Well that's what I thought regarding the system, also there would be a reg paid for that wouldn't have been logged by the cameras, suspiciously close to my reg.0

Ticket price = £100
Court Claim cost = £25
Legal cost = £50
TOTAL £175 (maybe a bit of interest
That is what a court will accept
So this boyo Haseeb Anwar thinks he can add £25 twice ????
Total ABUSE OF PROCESS BY SIP
There are no damages for £60 and that is also ABUSE OF PROCESS
Haseeb Anwar does not have much going for him if he thinks he can scam a court like this0 -
The legal cost mentioned above is only lawful if it has been paid. Can they produce a vat receipt for that amount? I doubt it.
The £60 they are claiming for "damages" is inadmissible, they are already claiming £100 in damages for an alleged breach of contract.
Nine times out of ten these tickets are scams so complain to your MP.
Parliament is well aware of the MO of these private parking companies, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.
Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

Just as the clampers were finally closed down, so hopefully will many of these Private Parking Companies. You never know how far you can go until you go too far.0 -
What is the Issue Date on your Claim Form?
Did it come from the County Court Business Centre in Northampton, or from somewhere else?0 -
I agree that the damages are a ridiculous addition and will definitely cite the abuse of process precedence.
yes it came from the county court business centre, the claim seems legitimate but the logos are such low quality and blurry, they look fake lol.
So far I've been reading as much as I can from the forums, but due to lack of evidence to present my current arguments are:
- That a ticket was purchased and no evidence in the form of a leger from the ticket machines has been presented.
- abuse of process described above by beamerguy
Are there any other arguments to make?
Also, I've seen on many threads, advice to be vague and not admit to being the driver for various reasons... would this be beneficial here, or would it be better to name myself as driver, and have my partner as witness?0 -
            sorry, issue date is 21/06/190

Go to the NEWBIE thread (first page of this forum, third thread down) and read post # 2, scroll down and you will find 17 defences, pick one (preferably a concise one written by Bargepole) and adapt it to suit your circumstances.0
