Hi all/anyone reading!
Had my responses from DVLA & CEL this morning......
DVLA have confirmed that CEL accessed my info 4 days after the incident (I wasn’t aware of this beforehand). They’re saying that new DPA doesn’t change them being allowed to release my information if the PPC has demonstrated reasonable cause to receive it.
Had info back from CEL. They’ve sent copies of:
- the PCN (says date issued 5 days after incident but no date of when letter was sent to me - is this allowed or wrong?)
- the letter of notification regarding keeper liability - dated 38 days after incident and 33 days after PCN date)
- a final reminder 2.5 months after incident
- ANPR photos x 2 (entering and leaving)
- a letter 4 months after threatening to instruct their legal department
- 2 x ZZPS letters
- a Pre Action letter that I’ve never seen
- the claim form
Now I unfortunately haven’t kept any of the letters but I’m pretty confident that there have been more than that and i’m confident I didn’t receive the Pre-Action letter. As I can now only go from the info they’ve sent me, is there anything about the above that sounds wrong that I can use in my defence? Especially about the PCN, letter to keeper and dates etc? Just an update - MP wrote to CEL, BPA & Court and had a letter from CEL saying they’ve discontinued proceedings and have notified the Court of the same. Great advice on here thank you, what a relief!0
