Afternoon kind folks,

I was looking for a bit of advice with this Parking Charge.

A Mcds in Scotland, issued by UKPC. I have checked a lot of the newbies thread and various others but cant find one which clearly fits the bill here.

The newbie thread says "IF THE EVENT TOOK PLACE IN SCOTLAND OR NI, WE SUGGEST YOU DO (ALWAYS!) COMPLAIN TO STORE MANAGEMENT IF YOUR PCN IS FROM A RETAIL PARK, BUT DO NOT APPEAL"

But I see a lot of threads (and no suggested templates for complaint to Mcds) which suggest going through appeal and getting a POPLA ref.

Which do I follow?

- Complain to McDs? If so who do I complain to Mcds direct or how do I find the contact details for the manager? Its not a place I visit often.
- Follow the appeals and get a POPLA?

Driver says, basically, arrived in the dark, only sign on the entrance route is turned sideways so its not visible if driving in. Parked in a bay near the entrance. Went for a snooze next to a high sided van. As driver reversed out they noticed the sign that was being hidden by the high sided van advising about parking times. Absolutely no chance of spotting either in the dark.

    Edit your post to remove information about who did what. Only ever refer to The Driver and The Keeper, who are two different people.

    In Scotland, only the driver can be held liable, not the keeper. Parking scammers read these fora and have been know to use information from here against a motorist.

    I have no idea where you have seen posts about appealing in Scotland. The advice not to appeal from the NEWBIES is quite clear. Please follow it.

    As for complaining to McDs, look up the details for the location and contact details for the manager there, or look up the contact details for the CEO.

    In addition, complain to your MP abut this unregulated scam.

    Did they post the PCN to you, or put it on the windscreen?

    DO NOT use POPLA in Scotland - that sevice is new and bad North of the border, as they insist on appellants being totally STUPID and naming the driver...

    The PCN was sent to me by post as the registered keeper. The driver details have been edited. I will not use popla.

    My first one, so just trying to make sense of all the ins and outs before acting. I may have misunderstood some of the threads.

    I am in same position as you regarding parking ticket in scotland. The thread recommends complaining to retail manager and yet this will be an admission tat you were the driver, and so when manager contacts UKPC to get ticket revoked, the UKPC effectively has an admission by keeper that they were the driver. This conflicts with advice to not respond at all. So what is the best course of action, wait until they take you to court?

    This just is not true. The keeper complains to the landowner/retail manager as keeper without saying who was driving.

    It is quite possible that the keeper was an occupant of the car so has first hand knowledge of what happened on the day, but there can be no inference as to the identity of the driver unless someone is daft enough to mention it.

    Struggling to get the manager/owners details as staff will not divulge.

    Any suggestions?

    So it's a franchise ?

    A couple of years ago I had a problem with a member of staff in the drive-thru at McD. He was very rude.
    So I asked a more senior member of staff to tell the owner to phone me, she did, he was sacked.

    But, you're quite safe to ignore the charge in Scotland if the driver's identity has not been revealed.

    Thanks, is this safe? Even if they send letters etc to me the Reg Keeper?
