Good evening all,

Just wanna see if you could help me out please,don’t know if it has ever been brought up yet.
Unfortunately had to enter the IVA in 05/2013 and successfully completed it and got all the relevent paperwork,such as completion certificate and etc.
One of the creditors,Instant cash loans which was included in the IVA,decided to default the debt just two years later (10/2015)after the start if the IVA, which i believe or as far as i know they couldn’t do. The default dates should be no later than the IVA. Correct me if i’m wrong please.
So please can someone advise what’s the best way to get the default date corrected and removed from my credit report cause that’s the only thing that’s seems to be ruining it for another couple of years which shouldn’t be the case.
The worst bit is they are now going bust because Instant cash loans is trading as The money shop as well and they’ve just ceased trading,so afraid there will be no one available to request the default date change/removal soon.
Hopefully it all makes sense what i’m asking for and one of you guys will be willing to help.

    Ask the creditors to change it.

    If that fails, ICO.

    As above, write and request they change the default date as per FCA guidence, it should certainly be no later than your IVA approval date.
    Failure to comply would see the information commisionaire getting involved :

    It is either an innocent mistake in the recording system or an evil attempt to prolong their presence beyond the 6 year threshold, ensuring you still find it difficult to obtain credit.

    Like the others have said, approach the data source and request its correction and if they refuse, then the ICO can force them to do it instead.
