Ex threatening to not pay Mortgage

Hi everyone
I'm a newbie and I have a interesting life at the moment to say the least.
I am in the middle of a divorce from my abusive ex and he's threatening to stop paying the mortgage on a house. This will be when the mortgage rates go up in November.
I cannot work as I'm caring for our daughter who is not very well.
it would cost me too much to pay to have someone look after her for me to go to work although I would like to work and I don't have any family to look after her.
Has anyone had a similar experience and can give me advice on what would happen if he did stop paying the mortgage?
he earns an awful lot of money after tax a month and isn't paying any child maintenance because he's paying the mortgage. on the official assessment for the child agency website he owes me an extra £100 a month on top of the mortgage but has never paid this and has said that if l go ahead he will stop paying.
As I'm living in the property , would I end up with a huge debt.

    Why not tell him if he stops paying you will be forced to go down the child maintenance route.

    At the end of the current deal you should be able to switch products with the lender so hopefully there will not be too much of a jump in rates.

    If he stops paying the mortgage and you do not pay the mortgage, the house will be repossessed. This is not necessarily a bad thing as the local council will have a duty to provide you with temporary accommodation, and you will able to get benefits to allow you rent somewhere that is unconnected to your abusive ex.

    The best advice I can give is to make a note of everything your ex does or says, but don't react or engage with him directly, negotiate with him via your solicitor or a professional mediator.

    Both of you have a responsiblity to pay to house your daughter, so you need to look into what benefits you or she might be entitled to in order that you can contribute to this. There is a very good benefits calculator at EntitledTo.co.uk.

    Check to make sure you are claiming everything you are entitled to claim benefit wise.

    Check to make sure you are claiming everything your child is entitled to benefit wise.

    How much is the mortgage payment? Is the mortgage in joint names or just your ex's? Does he realise missing mortgage payments will screw up his credit history, having a repo will be even worse?

    At the moment he is still trying to control you because you have got out of the relationship. You have come too far to let him do that.
    Mortgage started 2020, aiming to clear 31/12/2029.

    If can't pay and won't ever be able to pay the mortgage they will just go after him or take the equity

    How much equity in the place?

    I have looked into child maintenance route. Solicitor has stated he should be liable to pay just over 100 more a month.

    The mortgage is roughly 950. a month. He earns 3.5 k after deductions a month.
    The house is jointly owned and l payed the deposit of 24k which l can prove.
    I receive 530. a month and waiting on DLA.for daughter
    Just in s horrible position at the moment.
    I am tempted to call his bluff.
    The financial hearing isn't for a while.
    If l put the house on the market now and it sold , the likelihood is it wouldn't go through before Nov and would he then not pay the mortgage for the hell of it.
    It's just frustrating as he is v domating and he's going to stop at nothing trying to ruin me one way or "another."

    Is there any equity in the property?
    Could you live somewhere cheaper?


    Selling may well not be a good idea.
    You would not get repossessed for a long time.
    This is a last resort and there would be many months of warning.
    Your lender might agree to lower payments or a payment holiday.
    Your best bet is to keep them informed so they can work with you.

    If he stops paying the mortgage and it is defaulted he will ruin his credit rating. Unless he is the type of person who will ruin you and see you homeless at all costs he is unlikely to do that and it is just bluster. Let your lender know and they move you on to a lower product although in all likelihood he would need to agree to that too as it is a joint mortgage.

    If he should be paying 100 more than the mortgage then go to the CSA. They will force him to pay, by an attachment of earnings order if necessary. That should put you on a more secure footing.

    So ex is threatening to stop paying the mortgage before Christmas if house isn't sold.
    He is a control freak and would like to ruin me. Im 70 percent sure he would do it just to ruin me.
    He takes every opportunity to play games and twist things whilst telling me " you know what a lovely person l am really".
    Is there anyway he could talk to the mortgage company and swing things against me. He has an i.q of 120 and has to come out on top.
    Should l talk to the mortgage company and tell them my position?

    Point out to him:

    a) if does stop paying the mortgage his credit rating will be trashed
    b) you will go to the CSA to ensure you get the maintenance you need

    I doubt the mortgage company would say or do anything until the money stops coming in.
