Retrenchment not Official !!!

Good day,

can I hold company liable in anyway if my manager lied to me about retrenchment

I was recently told by my employer ie. line manager in our boardroom with 2 other colleagues that I will be retrenched due to me been there shortest time.

As I was going for interviews and such I was told I can't tell them I'm been retrenched as it can tarnish company and have legal recourse. I asked for a confidentiality form so I could see what I can say. Turns out NOT EVEN the HR knows about this.

I had to cash out my pension to fall back on due to this. I have lost money as I get penalised on taxes.

I have sufferred trauma after been told about retrenchment. I left a permanent position of almost 4 years to join a international company.

I'm so disappointed in humanity and now I want justice.

    I'm sorry I'm a little confused. What are you wanting justice on? That you didn't have savings so needed to cash in your pension? I doubt you can do anything about that.

    You say he lied to you, I'm guessing you are no longer there (hence cashing in your pension).

    I don't really follow....

    Retrenchment isn’t a term that I’ve seen used this way before, are you using it to mean the same as redundancy?

    I think that you need to give more information, why would being let go mean you need to cash-in your pension, and how long have you worked for this company?

    OP - are you employed outside UK? Your contract of employment ought (?) to say what country's employment laws apply to it.

    I’m confused as to what the issue is. Are you saying they were not planning on making you redundant so you found another job and then they’ve decided not to make you redundant? Or something else?

    Are you working in the UK?

    I read that the Op left a permanent role to join a new company in what I assume was a more attractive position. The new company then a period of time down the line, decided they did not want to maintain the position so made the Op redundant.

    Op are you living in the UK? just need to check if any advice given would be correct. Unfortunately if you have been with a company for under 2 years, they can make you redundant without reason. Unless you are able to demonstrate any discrimination behind the decision to terminate your employment I doubt there is much you can do. The fact you left a more stable job to take this up is sadly irrelevant as opportunities sadly change all the time.

    I also cannot think of a reason however why you couldn't say you were being made redundant when applying for other jobs, unless the line manager was confused or didn't fully understand employment law.

    If the assumptions above are correct I can’t see what the complaint is. Companies hire people, companies let people go, if the staff that they let go have not made enough provisions to cover this, or they don’t find a job quickly enough this is not the employer’s fault.

    OP, if you genuinely want advice to need to provide some more information. What happened, why do you feel it is illegal, and why, if you had to cash in your pension was it your employer’s fault?

    I’ve been let go from jobs before, for various reasons, it’s just something that happens, a fact of life. Maybe I aimed a bit high, maybe I was not committed enough, or perhaps plans changed. A job is never for life, and being taken in does not make the employer your guardian. They pay you for your time and effort until they, or you, change their mind.

    It looks to me like the manager dismissed the OP but tried to make it easier and less emotional by saying it was not personal, but a need for staff reduction.

    OP, did you actually leave your job, or were you only expecting to have to? Have you now found another job?

    Unfortuantely, if you left voluntarily, even if it was beacuse of misleading information or a misunderstandin, then I doubt that there is anything you can do.

    Ifyou haven't left, then the lesson to take away is probably to double-check anything this major with HR before you take any steps, in future.
