ESA to JSA

I'm hoping someone can help me.

I'm currently claiming ESA income related along with child tax and cb. I've been volunteering for a year now for the Royal voluntary service at my local hospital to regain confidence and gain new skills after an accident in a previous job. So I've been looking for work and apply during my time volunteering without any luck. This week I had the capacity for work forms. Know I'm not worried about being declared fit for work, but my concern is if I am will my entitlement drop to just the JSA rate of 73.10pw? I currently receive 102.15pw on ESA. That drop in money would be a huge blow I'm only just about managing now.

    If you're found fit for work your ESA will stop completely. You will then need to request the mandatory Reconsideration within 1 month of the date of the decision, most MR decisions remain the same. You won't be paid any ESA while you wait for the decision. You will be able to go back onto assessment rate for ESA once the Tribunal accept your appeal.



    If you claim Universal Credit after you've been found fit for work then you won't be able to go back onto assessment rate of ESA. Claiming UC will mean your tax credits will stop and transfer to UC. If you claim housing benefit then this will continue for 2 weeks and then transfer to UC.

    But she is fit for work? Why are you telling her to do a mandatory reconsideration? This would be a basic form of benefit fraud to claim extra money.

    The OP hasn't been found fit for work. You're allowed to do permitted work while claiming ESA but if it contradicts the reasons they are claiming ESA then they could be found fit for work. My advice above it correct.
