PRA avoiding CCJ

Hi all,
Recently I cancelled my payment plan with Stepchange as I wanted to manage the debt myself.

PRA wrote to me asking me to complete an income and expenditure form or they would possibly apply for me to receive a CCJ. I therefore completed the forms straight away however, the next letter I have received is a court letter saying that I have to fill some forms in and pay court fees etc.

I called PRA who said they didn't received the returned forms and there is nothing they can do to stop proceedings.

Other than paying the £2000 debt that is from a Lloyds credit card which was defaulted in 2009. Is there any other way I can stop the CCJ?

    How quickly can you get the money together, including solicitors costs, court fees and interest?

    You could ask PRA if they would agree to you paying £500 pm (guessing the total figure), for 4 / 5 months and not request a CCJ be entered. They have 6 months from the date of issue to request a judgment else they need to apply to the court.

    You could try and defend it, but you will still end up with a CCJ.
    Mortgage started 2020, aiming to clear 31/12/2029.

    Exactly what letter and forms have you received? Is it a Pre Action Protocol letter? Does it look like the letter and form in the link below?

    Yes, it's your debt, they have issued court proceedings (probably jumped the gun, but I don't know how long it was between you receiving and returning the I&I to them, but that's debt firms for you), but unfortunately:

    1. you either pay it all now,
    2. file AoS to delay it a bit then pay it,
    3. or try to get them to agree to defer applying while you pay substantial instalments.
    4. Only alternative is they get a CCJ and you pay it within 28 days, but extra costs, fees and interest will be added.

    It is a !!!!, it does stay on your file for 6 years, but after a while (4 years for me) companies start to ignore it, but it could be a problem with your job if you work in a financial institution, accountancy, law (huge oroblem if you are a solicitor, - or doing your training contract / LPC, Legal Executive, qualified paralegal or Step qualified) but some firms understand, utilities and insurance etc.

    For car insurance some companies won't touch you with a barge pole, some are ok if it's under £500, some slightly higher. If you use a comparison site make sure you phone the insurer directly before taking out a policy to check they have no problems with it.

  • You can "stop" the CCJ by paying it in full within a month of the judgement date.

    This will stop it appearing on your credit files for 6 years if unpaid or not paid in time.
