Allegedly Partner Accidentally Ran Red Light

Please can anybody help, or give advice to the keeper of the vehicle on this one.

My partner was waiting behind a car at traffic lights in Leeds, when the car in front moved off.

The keeper of the vehicle then assumed the road to be open and followed the car in front, as many would do. A camera flash was noticed at the time.

A 'Notice of Intended Prosecution" letter from the Police arrived today, stating that the motor vehicle failed to comply with red/green arrow/lane closure signals/automatic equipment.

The letter does state anything on payment, nor give the opportunity to pay a Fixed Penalty notice etc, so they are extremely worried what is going to happen or whether they will be forced to go to court.

The reverse of the letter just asks to tick the box if you were the driver at the time of the alleged offence, and if the names are correct. Which they actually aren't.

Does anybody know what the usual process is for these types of tickets, or what to expect?

There is no mention of appeal or if it is possible to give your side of the story in court.

Would anyone think this could be a good idea, perhaps a court might be interested to hear that the view was obstructed by the car in front?

I realise this may not be the correct area of the forum for this one, but as always, any help on the matter would be greatly appreciated.

    Fill the form out and send it back. If he is prompt he MAY get the opportunity to go on a course rather than be prosecuted.

    If a course isn't offered this can all be dealt with by post. No need to go to court as long as you are prompt with the paperwork. That's assuming he hasn't got 9 points at the moment.

    Court will not be interested in excuses. Following someone else is not a defence and could lead to a highe fine.

    If you aren't offered a course you will most probably offered a fixed penalty of £100 and 3 points.

    my lad has just had something similar for running the amber light at a traffic light crossroads

    as keeper he has the choice of 3 points and a £100 "fine" or a driver awareness course of £90 + 4 to 5 hours on the course


    I dont think he has ANY points on his DL at the moment


    the KEEPER of your vehicle should ALSO check the details are correct on the V5C and correct any ANY SPELLING MISTAKES or ERRORS if any are found

    Are you sure that this isn't just a S172 notice to confirm the driver details? Return the form as said (and to correct any spelling errors) ... and then wait. What'll probably follow will then be what the authorities wish to do (course, points, court).
