Brittania Parking Ticket POPLA Advice

Hi There,
I received a fine in the post from Brittania Parking on 19th May.The location is a pub in Coventry. I Appealed as the Keeper using your helpful template in the Newbies post. The appeal got rejected as expected and provided with a POPLA code. They have taken photos of the signage and vehicle entering and leaving the premises along with a screenshot of the payments made in the system. This was sent this in the .PDF rejection letter received by email dated 13th June.
The ‘driver’ has been visiting this pub for many years and did not notice anything at the time only when leaving the premises (too late at this point and annoying as the staff didn’t want to know when approached after the letter received). The carpark has only recently had this setup and used to be free as you would normally expect from a pub.
I’m unsure how to correctly appeal to POPLA as the fact is no ticket was purchased accidently. Is this something I would unlikely win and be required to pay up? Im only saying this as it is a situation whtere the driver had honestly not seen any pay/display until it was too late. Apologies if there is something obvious I have missed… Any help would be greatly appreciated.

Escalate the complaint to the pub - to head office if no one locally high enough to see the damage being done here to their business.
Ask (demand!) they intervene.

My concern is if I complain and demand, what If I dont succeed here? Would I have to reveal the driver?
What are your thoughts on winning if the complaint fails? Only asking because it was a case off accidently failing to purchase a ticket?

Never reveal the driver!
If your complaint to the pub fails then proceed to the popla appeal (don't miss the opportunity to appeal to popla - note the deadline for appealing
Simply accidentally not paying obviously no good as an appeal!

Were there signs up outside the pub explaining that the system had changed? BPA code of practice states that if changes are made, signs should be erected advising locals (who would have been used to an old system) that it was now different.0

These are not fines, they are private invoices for the damage the PPC alleges they suffered when, allegedly, you breached a contract they allege you had agreed with them, we call them scams. They only need to be paid if a judge so directs,
If the pub will not cancel write bad stuff on their Facebook page, TripAdviser , and any local good pub guides on which they features, these scammers can affect their bottom line.
Nine times out of ten these tickets are scams so complain to your MP.
Parliament is well aware of the MO of these private parking companies, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.
Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

Just as the clampers were finally closed down, so hopefully will many of these Private Parking Companies.You never know how far you can go until you go too far.0 -
No there werent to knowledge just the sign in the entrance/car park which in my opinion how can anyone read without stopping the car. The staff inside did not mention anything according to the driver (likely why it was only noticed when leaving the premesis). The rejection .pdf from Brittania only shows the Brittania signs in the car park. In the meantime I will try to work out how to escalate my complaint!

winning this at popla would depend on finding a technicality, not on "what happened"
these would include
INADEQUATE SIGNAGE
BPA CoP failures (like new rules and new signage)
any POFA failures
NO LANDOWNER AUTHORITY
No keepr liability
etc
download and read the BPA CoP , January 2018 edition
the staff should have alerted customers to the new rules , with signags inside and out etc , so that the customer is in no doubt as to what to do
I went out last sunday for a meal, there were adequate signs in the car park and a sign near the door telling people to register the VRM inside on the terminal
the IPAD type terminal was on the bar as you walked in
it should be that obvious from the moment of parking right through to the moment you are stood at the bar which it was for all of my party, including me0 -
Do not even try POPLA until you've exhausted the complaint to the top.
The POPLA code lasts 32 days, not just 28, no dissenting voices here!
So you have a month to find the person at the pub or chain who will cancel this.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Quick update!
Called the Pub customer care as its a chain (Green King Pubs). Explained the situation and they cave created a case with a reference number which will then be looked into.
I believe I have until the 14th July until the POPLA code expires. Due to go away on 4th until the 7th July. Hopefully hear something by then and get this cancelled.
