Filed AOS but forgot to file Defence

Hi everyone hope you are well

I was served with a claim form for Northampton County Court by the one and only Civil enforcement LTD.

I was served this on 14th June 2019 and then filed my AOS. I believe I had until 17th June to file my defence which I have no yet done. It is ridiculous but I have had a lot going on in my family life and this was the least of my worries and needless to say I forgot.

What is my option now? The parking fine relates to me parking in a bay last year in july, I set up my card details through my phone and entered in my number plate and from what I thought I had paid. What I wasn’t aware of is that I hadn’t responded to a text message that was sent confirming my number plate, but because I had already confirmed this by telephone I did not think that it affected my parking time and from what I thought, I had paid for my duration of stay.

This is getting ridiculous:cool: and they bombarded me with several threatening letters which we ignored from reading these forums, and I thought I could defend the case but just my luck and attitude that I missed the deadline. I have now got to a point where I want this all to be over and not have to worry about what is next and I would rather much pay the £300 even though I know they are scammers and I have done nothing wrong as from my perception I did all in my power and what was advertised to do to pay for parking.

Can someone please shed some light and give me some direction because I’m baffled that this is the situation that innocent people fine themselves in because of these bullies.

    1) What was the DATE OF ISSUE on the claim form?
    2) How did you file the AOS? Online? When did you do this?

    Your dates make absolutely no sense. You have at least 19 days from date of issue to file a defence OR AOS, and if you do the latter you get another 14 days. Assuming your AOS was actually accepted and received - which youve failed to tell us how you did it so impossible to know - you should not be out of time yet. The 17th June as a date does not fit, unless you received the claim form VERY late.

    You cannot do this in a rage, because all we need to know is some key dates. So, tell us them. Calmly.

    Are your dates correct?

    If so you have plenty of time to sort out your defence

    Please confirm the dates

    Apologies for that m, after re-reading I definitely need to clarify the dates correctly for you.

    1) I received the claim form on the 14th May****

    2) I submitted my AOS online, following the newbies thread on 3rd June

    What was the actual 'issue date' top right of the claim form N1?
    PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

    ALso, if youre only late by one day (which youve said when you hijacked someone elses thread, rudely) then why not jsut get the damned defence in NOW?
    You just have to beat them to the punch. If they have already requested default judgement then you will have no choice but to pay. NONE whatsoever.

    The ppcs monitor this forum and can use posts in your thread against you

    We hope you will both be (that poster and you) in time to avoid the Claimant going for a default. Think of it as a race and must be done now!

    In your case you CANNOT copy that defence as it's about a residential car park/perit matter, not about a PDT machine or phone app case.

    In the NEWBIES thread post #2 in the example defences there IS a 'phone app failure' example defence right there waiting for you to adapt, I'm sure! Do not admit to fault - blame the phone app for not being fit for purpose, not yourself.

    Make sure your completed defence has the right headings and statement of truth, and sign a hard copy. Doing this in the next 2 hours will potentially save you hundreds if you win this race, then win at your local hearing in the end with our help!

    DO NOT ASK US TO CHECK IT - NO TIME!

    Then scan it and attach it to an email that tells the court in the SUBJECT LINE:

    Urgent defence - claim no xxxxx
    PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
