Hertz admin fees for PCN

    So I will talk to by bank about this again today, I have also contacted Hertz and they have said they are opening a case but I have not heard anything since.

    Is there any scope to arguing that they had no right GDPR wise to share my name and address with a third party?

    Re GDPR, if the third party has complied with the protection of freedoms act, and if they have complied with the DVLA's KADOE contract then data sharing in those circumstances Is allowed.

    note the use of the word if.

    Yes, if the hire terms only talk about penalties & fines from 'authorities'.

    I have found this company reasonable and ethical. They have been in business for 100 years and have 10,000 concessions so must be doing something right. Why do you think that they are scum?

    The key issue is that most people don't understand the difference between private parking notices (PCNs) and local authority regulated penalty charge notices ( PCNs)
    And this most people issue also includes staff at hire/lease company's.
    The bigger issue with hire company's is should they be able to charge for real penalty charge notices, ie automatically pay and then charge the consumer, plus add a hefty admin fee as well ?

    I do not think that they should, the hiree shouldn be allowed to appeal them.

    It could be argued that this constitutes an unreasonable term in a consumer contract under the Consumer Rights Act.
    You never know how far you can go until you go too far.

    No...it was all done and dusted without a hearing...they got the court papers delivered and settled within three days of them dropping on their doormat.

    If they were "reasonable and ethical" they would have changed their procedures once they realised they were in the wrong...but they haven't!!


    The case I speak of was circa three years ago...so how many people have they scammed/stolen money from in the meantime?? I'd say that that qualifies them for 'scum'.
