Small Claims Court Fees

Options
I made a claim against someone that owed me some money. They have responded to my claim by paying the original amount owing but not the total on the claim form which includes interest and the claim fee.

I thought that the defendant had to pay the total on the claim form. If they did not agree with it do they don't they need to defend the claim?

Can someone please advise?

Many thanks!

    When did you receive payment?

What's the date of issue of the court proceedings?
Mortgage started 2020, aiming to clear 31/12/2029.

Write to the Defendant; explaining that they are required to pay £x to cover the fee you paid to the court, and that you will be proceeding with the case to recover that fee unless it is now paid.

I assume you complied with the pre-action protocol - i.e. letter before action giving them 14 days to pay before you issued proceedings?

Did he admit he owed the full amount on the paperwork he was sent? If so the ccj is essentially passed with a rubber stamp.

If you don't confirm to the court it has been paid in full within 2& days it shows on his credit file.

I'm guessing by admitting it and paying up that's something he wants to avoid. It might be worthwhile pointing out to him that he won't avoid a ccj on his record unless he pays the entire balance.
