    If you're going to counterclaim, then that must be tagged on to the defence and the appropriate fee paid with it. It cannot be claimed separately later.

    Thank you, Umkomaas, and thank you also for your input yesterday regarding the pricings etc. I shall be sure to include everything with the defence once I'm satisfied that it covers fully what I want it to.....or rather what it needs to :)

  • WE WON!!!! From the County Court today - "IT IS ORDERED THAT The claim is struck out as the Claimant has failed to comply with Paragraph 1 of the order of 9 September 2019"

    Thank you one and all for all of the advice and support throughout. Essentially, we succeeded in proving that VCS had NO authority to be operating a pop-up car park on the land in question. This would therefore suggest that anyone else who has been taken to court by them (and lost) or who has even just purchased a parking ticket whilst the site was operational might well have some sort of a case against the scumbags themselves. If anyone has any advice about how such procedure(s) might be instigated (and brought to people's attention), then please share accordingly. Thanks again everyone :)

    so as well as your consideration re a claim .... this could cause them considerable grief if it got reported in some local/national rag .... not sure how that could happen though. ;)

    Your are right VCS probably owe people a lot of refunds

    A few years ago, I battled over a council ticket and won via the Traffic Penalty Tribunal. The silly council rejected the TPT result and again the TPT ruled in my favour.
    I went to the local press who printed the story and I was saying that anyone who has paid for the same area should be refunded by the council. :)

    The council went mad and threatened me (via the newspaper) with taking the case to the High court. My retort via the newspaper was how the council would explain such a waste of money to the residents/rate payers. Suffice to say I never heard anything more

    So, the moral is whether it is a stupid council or a stupid private parking company, YOU EXPOSE THEM for trying to defraud the public. You are now running this, not VCS

    Thank you Beamerguy. I wondered whether the local rag might be the way forward and I'll speak to some journos I know over the weekend. The beauty of this is that it's not the LA that I'm going to be exposing. Its a company that everyone knows already are just a bunch of t***s. The irony of it all is that the land concerned is right in the midst of the courts and vast numbers of solicitors offices, so many of those who will have been penalised will be workers who had paid the £3.95 day rate. If just one of those were to become involved then who knows....we might finally be able to put one very big nail in the coffin of VCS and others like them.

    Great result ..... and it's great you have the bit between your teeth and looking to go for the jugular.

    So many who win their case are just so grateful to have done so, but then melt into oblivion, missing the bigger picture in what needs to be done to really hit this scamdustry.
