    How weird! Email them and thank them for their NOTICE OF DISCONTINUANCE and ask to check that they have indeed filed that with the court. Give them 48 hours to confirm; make your email precise.

  • I assume that if they've sent the same copy to the court then they will only skim read the first page and discontinue the case.

    However, I guess they can re-open it?

    What's the value of me emailing to confirm and giving them precisely 48 hours?

    Don't guess.

    That is why I suggested an email to paint them into a corner so they have to confirm, and can see that they sent you a Discontinuance (just in case it was a mistkae, they will be stuck!).

    The point is the 48 hrs means you will know this week, that you won. At the moment you are guessing and they have confused you (but don't tell them that).

    I received a notice of allocation to the small claims track (hearing) scheduled for December.

    The front page was about mediation?

    Yes, prepare your Witness Statement, gather your evidence and put together a Costs Schedule.

    How to do all those things is described in great detail in post #2 of the NEWBIES thread.

    By what date do you have to supply your WS and evidence?
