Advice on Robinson Way and CCJ?

Hi,
Really hoping I can get some advice.
Robinson Way a debt collection agency is currently in a email exchange with myself as they are telling me I have a old debt. I emailed them with the statute barred letter and asked for more information (obviously I don’t want to pay some random company money without proof)
Within the 21 days they replied saying they were still investigating the debt. They have got back to me now saying that the debt was a CCJ back in 2005 so the statute barred doesn’t apply.
Again they have no proof of what this alleged debt is. But they have said the matter is now closed and I have 30 days to contact them.

I emailed back asking for proof (again) I just don’t know where to go from here. As it was so long ago there is no CCJ on my credit file I’m stuck. Can anyone advise?

    If they don’t respond either ignore them or contact the FOS and raise a complaint there.

    County Court Judgements only show on the Register of Judgements, and on your credit file, for 6 years, after that they just drop off both entries.


    They never go statute barred, however, the creditor would need to go back to court to ask permission to further enforce the judgement, if it were older than 6 years, as yours appears to be.


    Given that 8 years has past since it would have dropped of your file, the court is unlikly to approve such a request, and Robinson Way will know that, you need to quote the above to them in a letter, and let them know you are not a doormat.

  • Thank you for your help. Robinson way have said that they will hold the account for 30 days but I must set up a payment plan. I’m concerned that they will attempt to take this further. But from what you have said they will need to go back to court to do this. What’s the worst that can happen?

    They can`t take it further, they can`t do anything, they must go back to court in order to do this, after 14 years since judgement, it would be a first if a judge allowed it.
    Robinson way can set whatever meaningless timescales they like, they are nothing to do with you.


    Write back to them quoting what i have said, and i doubt you`ll hear from them again.
