Euro Parking Services PCN

I have received a letter before court action from euro parking services asking for a payment of £160 (I am struggling to upload a picture of it, if anyone can help with how to upload pictures).


The PCN is for the driver parking in a disabled space for one minute (they give the times on the NTK) whilst waiting for another driver to pull out of another parking space. The reason was for parking in a disabled space without clearly displaying a valid badge. It was done through CCTV.


After reading through the Newbie thread multiple times as well as other threads I have issued two responses: a) that the notice to keeper letter was incorrect as it was issued 36 days after the contravention date. b) a subject access request to Euro Parking Services.


Additionally I have rang Tesco to see if they could remove the charge but unfortunately they were unable to help.


My questions are as follows:
- Is the letter I have received an actual letter before action? as from what I have read I will receive that from Gladstones and not Euro Parking Services.
- As it was a disabled space does this make any difference?
- Is there anything additional I should be doing and what are my next steps?

    Depends if the duration given was 30 days or less and you didn't say which. Nor if it contained financial forms either

    Euro can issue an LoC if they wish, or contract a solicitor to do it, their choice to make

    Signage and the relevant Cop tell you about grace periods or not

    The SAR was the important thing, plus good research

    Hang on, how could CCTV, which PPCs rarely, (if ever), use, pick that up?

    It didn't contain financial forms and the duration given was 14 days, I am therefore presuming that it is not an actual letter before court action and that I should ignore it?

    It is a DCA letter and can be ignored. Can you please confirm that CCTV was used and not ANPR?

    Nine times out of ten these tickets are scams so complain to your MP.

    Parliament is well aware of the MO of these private parking companies, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.

    Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

    Just as the clampers were finally closed down, so hopefully will many of these Private Parking Companies.

    That's a non-POFA late NTK, so no chance of them holding the keeper liable as long as you don't blab about who was driving.

    And CCTV images cannot POSSIBLY show a car without a blue badge, what a scam:

    I'd be telling them that they are utterly deluded by money and blinded by their scammery, if they think remote CCTV images spanning one minute flat, trained on a car waiting to park as another driver exited the space ahead, is evidence of the car being parked in that disabled bay and left in a space without a Blue Badge. Certainly cars can access and egress over those markings in the course of driving, to get to another space.

    Finish by telling them their NTK was a month late so non-POFA, and the driver will not be named by the keeper to protect them, and the keeper is happy to defend this baseless case in court despite having no liability. And the keeper will seek full costs on the indemnity basis when the keeper wins, costs which have far more chance of being granted than their fake £60 imaginary and unrecoverable added cost.

    Tell them you will require the FULL images taken during the 5 minutes either side of those still photos, to be shown as evidence in court, and Gladstones might need reminding that their first duty, as solicitors, is to the COURT, not to the money-grabbing client. As such, the CCTV images must be retained in full by the Data protection Officer as they prove the fact the car was moving then waiting for an adjacent space.
