Apple Iwatch help

Hello, I bnought a series 3 apple Iwatch Jan 2018 - it has never properly recorded my swimming activity. I went through several online chats with apple over the last 15mths but nothing worked. So they arranged for me to send if for repair. They have no asked for £180 plus vat to fix a tiny mark on the case - no where near the glass before they will fix the sensor problem affecting the activity recording. When I called the advisor explained that the tiny mark repair wasn't causing the problem but it was their policy that any damage no matter how small had to be paid for before fixing the sensor. This is a sports watch - I have worn it every day for 15mths swam, trained and travelled with it. It has very little wear and tear but surely it is reasonable under the consumer right act to accept that wear and tear happens and shouldn't cause them to decline to fix a fundamental fault with the watch. They said if I wasn't happy to write to their HO in Ireland - no email address available. If you saw the watch it would take you a while to spot this tiny suface mark. No damage to glass, case or near the glass. Any ideas?

    Did you buy from Apple ??
    If not then its the Vendor who you have Consumer Rights against .
    Yes it is normal for screens scratched etc to need replacing for a fault .


    Warranty a free gift subject to terms and conditions from the manufacturer .


    Consumer Rights your rights under the law against the vendor not the manufacturer .
  • Yes I bought direct from Apple. It isn't a scratch on the screen it is a tiny mark of the outside case not near the glass and not substantial in any terms
