CCJ advice

Ok my parents have avoided a CJJ for a while now.

It’s approx £9,200.

I got the ref number for them last night and it’s now time to sort it out.

What’s the best way to start this process?

Some of the debts I believe are over 5 years old.

My mum has said she has a friend who pays a set fee each month and after 5 years if the debt is not paid then it is wiped off? Government backed?

This is new to me and I’m trying to help them.

The debt is credit cards/kitchen/other purchases.

    How many debts have CCJ’s ?

    9k of debt is not enough for an IVA which you refer too above.

  • They do have a CCJ against their names.

    The CCJ I found online only has case number and it says County Court Business Centre (I assume claimed online).

    There’s no further info on the CCJ.

    The CCJ was given in August 2017 so that’s how long it has been ignored.

    If you email the court they will provide details of the judgement for you.

    Normally you have to pay what the court tells you to pay, although this can be changed by application to the court.

    I assume the creditor is not currently seeking to enforce this judgement ?

    The court doesn’t have an address for them to send the paperwork, hence why it hasn’t been enforced.
  • What’s the best way to deal with the payment?

    They don’t have the money to pay.

    Are these voluntary agreements with debt management companies useful?

    They stayed the accountancy centre is the company their friend has recommended.

    They have used them previously to clear debt.

    The first thing would be for you to sit down with them and put together a Statement of Affairs (SOA) in order that they can see the full picture and how their finances lay out. The link for the calculator we suggest for this is in my signature below, or in the "sticky" post at the top of the board.

    The SOA needs to be honest and accurate and not "aspirational" - and it needs to reflect the way things are right now too, not what they think they should be spending. if they are happy for you to do so then posting it in here would be a good first move as we can take a look and make suggestions.

    By the sound of it they may be good candidates for a Debt Management Plan, but the SOA will shed some light on whether that is the case.

    It sounds as though they are looking at using a debt management company to manage things in which case PLEASE tell them to NOT use any company that wants to charge them any fees for this - the best companies for this are free to use - Stepchange and others.

    Please be VERY careful about involving dodgy companies and 'accounting centres'. And don't talk to anyone (at this stage) whose only product is an IVA

    Your parents (or you for them) can do a SOA and post it on this thread (the link is to a calculator - please format for mse)

    Now I know you mean well but if a creditor has not pursued a ccj for several years then it may be a mistake to wake it up. The creditor (whoever that is) could have located them by a variety of means and used one (or more) of several methods.

    When you list the debts can you state whose debt it is (mum, dad or joint) and whether it is being chased.

    OP I don't think you're quite getting this. DO NOT USE ANY DEBT MANAGEMENT COMPANY THAT A) ARE ONLY WILLING TO OFFER YOUR PARENTS A SINGLE OPTION TO PROCEED AND B) WANT TO CHARGE THEM MONEY FOR THE SERVICE. There are companies out there who will help your Mum & Dad for free, meaning that any money they have spare goes to paying off the debt, not lining a fat-cat's pockets. An IVA may not be the right route for them - again, a debt charity can advise about this and will do so with an open mind, rather than with the intention of their first priority being to make a profit from your parents.

    Sit down with your Mum & Dad and get the SOA done and (get their permission to) post it here, and we can take a look and make some suggestions for you.


    On the subject of whether it is a mistake to wake the debt up at this stage - that's another question, however it seems to be sensible even if they decide to let sleeping dogs lie, to get their finances in order so that they can start setting aside money to pay off the debt should it wake up all by itself, as has a habit of happening. Also, if the situation is weighing heavy on their minds, it may be the right course of action for them to be proactive and just get it paid off. Either way, the first stage is the SOA and getting a proper budget in place.
