Employer wants to rehire me

At the end of May, my employer offered me voluntary redundancy, which I accepted. My last working day is the 31st of July. I have a copy of the settlement agreement signed both by myself and my employer.

Last week I was pulled into the HR office and offered a new role. They said that if I chose to take the new role, then we'd just tear up the settlement agreement. What are my rights in this situation? I'd ideally like to keep the redundancy payment if possible. And if I turn the role down (I do have another job offer on the table) would this affect my redundancy payment?

What does the contract say?

Can they withdraw?
Does it have any restrictions on returning.

This is not a redundancy VR is a mutual termination.

Negotiate if you want the job.
Check continuity of employment for future redundancy.

Any payment will become taxable.

Sounds like you need to respectfully decline their offer. Unless you want to stay. Are they offering you better money? Prospects? Benefits?

If you take the new role and 'tear up the agreement' then you won't get a payment by the sounds of it.

I know that some will not like the way that they've come back to you. But I wouldn't read too much into professional decisions.



If you are happy with the role and you like your work, go back. Take it as an opportunity to negotiate a better salary, you'll probably get it too.
