ESA C-Based & Legacy payments Non Dependant UC claim

Hi MSE Members change in circumstances info
My grandson aged 18 wants to move to the area and claim UC
UC has Replaced JSA he can come and live with me if he wants
looking at info under 18's dont count as non dependants you have to be 21
what will change for me?
i get ESA Contribution based with legacy payments
i also get PIP enhanced both sections and IIB Industrial injuries Benefit
i dont get any rebates rent or council-tax etc
doing these entitledto calculators say i dont qualify for UC. because of above income. can anyone tell me what happens if grandson claims with me. i cant get UC do i stay as i am now
i know i get some legacy payment in my ESA Contribution
these legacy payments arn't paid in UC But i dont qualify for UC
so this wouldnt change / no idea how it works

Your grandson and you are separate benefit units. Given that you do not claim Housing Benefit or Council Tax Reduction his claim probably does not affect your benefits at all.
However I do not know what you mean by "i get ESA Contribution based with legacy payments". Do you get an income based top up to your contribution based ESA? If you do does it include a Severe Disability Premium? If it does you will lose this premium.Information I post is for England unless otherwise stated. thanks Calcotti. on my ESA breakdown it says i get a top up amount each week thats come from me being migrated onto ESA from a older benefit . this is paid so i dont lose out finacially having been moved onto ESA . thats exactly what it says0

Are you claiming the severe disability premium in with your ESA? This is what you need to check. From April 8th this year it's £65.85 per week.0 -

i dont get the premium benefit as a Daughter gets carers for me and has my mobility car thats a god send its my legs i cant drive
the top up payment im mean yes its the transitional protection so you dont lose out transferring to other benefits as they have changed over the years like the old incapacity benefit changed to ESA afaik etc
as regards grandson a youth worker called after i chased up a service thats local that deals with 16-19 year olds wanting to know about grandson. i forgot as a little one he went to a special school that deals with down's syndrome pupils he was diagnosed as partial downs and autism when little. he eventually went to main stream schools struggled a lot with many activities like reading concentration and his writing is terrible. youth worker knows the school he went too she talked to grandson and in her opinion as UC is now job search 30-40 hours a week etc. hes just not going to do it. she said contact job centre get an appointment and see if they can offer some part time course and what options he has. thanks0 -

we had to wait on his old school setting up a meeting then getting some info on paper from his old school about his needs. he needed lots of one to one support at comp school and the report says his writing is poor like a childs sometimes the writing is backwards dyslexic he just cant write and his reading is the same he just cant read
he said he cant read and write so didnt want to do education courses or apply for jobs because he just cant do it. and doesn't like to talk about it.
trying to express himself communicate makes him frustrated the report says hes got learning difficulties and support his situation as of now not fit to work.
the ESA you ask about im in the support one that means im not fit for work. and its the contribution based ESA i dont get the financial ESA.
struggling to work this universal credit out
online calculators say i wouldnt get Universal Credit if this is a classed as a change in circumstances for me because im single and get industrial injuries benefit. and contribution ESA not the financial ESA
his mum contacted Job centre and they say he must claim UC on line and set a meeting up. to apply for it.
i have sorted him same GP Ive said can he see him about it said make an appointment GP will support the situation so i presume he'll say he's not fit for work until he sees mental health team.
his dad lives near by hes not willing to help in anyway. him and his mum are at logger heads often. hes want want want £££ but doesn't want to admit he needs help and it will take time
its getting me down he's welcome to come here i just dont understand if it will cost me my own financial help im entitled too because of my long term medical problems if it does pointless trying to help
i can just see him getting some initial help sorting DWP out GP support etc then after a month not going back to GP.
DWP stop his money then we'll all be back to square one thats just how he is a minute. he cant be bothered to cut me the grass tidy garden etc for £20
we can see his situation have for a while he cant see it. leaving school has been daunting for him

As I said in my first reply you and your son are separate benefit units. Nothing will change for you as you are not getting any means tested benefits. Your ESA, IIDB and PIP will all continue as now.
If your grandson has a Fit Note from GP saying he is not fit for work he can ask, when claiming UC, to be referred for a Work Capability Assessment. Is it possible h3 would qualify for PIP himself?Information I post is for England unless otherwise stated. Some rules may be different in other parts of UK.0
