    1) If they have issued court papers they will expect you to pay their fees for filing the claim.
    2) Send in the SAR. Now. Stop delaying. Not to Gladstones, you send the SAR to the PPC. You TELL Gladstones that you have sent a SAR and you are SEEKING DEBT ADVICE and they MUST not issue any claim for at least 60 days (30 days for SAR, 30 days for you to seek advice on the contents of the SAR) - as they are well within the 6 years for the Limitations Act, there is NO pressing need for them to issue papers which would override your right tot a delay.
  • How and where do I send the SAR, I went on their website (UKCPM) under about us and couldn't see where to send still
  • This is my draft letter letter is this ok?

    You can't ask for 'all information or evidence' part of a SAR.

    A SAR only gets your personal data, such as copies of letters with your address on, and all photos taken of the car as that's your personal data too (the VRN).

    You can ask GLADSTONES for 'all information or evidence' though (read the Pre-action Protocol for Debt Claims and see what your rights are, and use them).

    There is no CCJ risk and no risk of paying high fees, and every chance of paying ZERO.

    As they are seeking £160 now it would be stupid to pay that exaggerated sum, as the PCN was not £160 and even if you lost in court in the end, the Judge would only order you to pay about £175...so you can see there is no huge risk and NO POINT paying, given that we win 99% of defended cases here.

    Why not simply search the forum for:
    UKCPM LETTER BEFORE CLAIM
    and read the umpteen zillion threads with those words in that people ended up winning?

    You will learn soooo much more from other completed UKCPM threads, than here.

  • Ok so what should I send should I just delete the part I added in and send? And surely if it goes to court though, then I would pay the court fees? So it would be much more than 160?
  • Should I send the standard SAR without any amendments? And can anyone confirm about the court fees. Someone has told me I would be liable for them if they file the papers and someone else has said I would only pay about 175 total. Just want to be sure in what I'm doing as I'm panicking about this whole situation.
