Not sure how old this is. While the date at the top of the article is today (10/06) sometimes newspaper articles default to 'today's date' rather than the date when the article was actually published. On looking at the comments on the article, some are dated from 7 months ago. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Two government departments ???
Apart from the two ATA's operating in an unregulated industry was it ever legal for the DVLA to sell our details to PPC's
I of course understand POFA 2012 which was written by jokers, mainly the BPA I understand, and whilst it is written in that about the DVLA, was it ever legal under the previous Data Protection act ?
The new GDPR is very explicit in it's meanings and whilst the DVLA must be allowed to provide info to Police etc, I fail to see where private companies have the same permission granted0 -

It's like Groundhog Day with you sometimes.
Regulations 27 and 28 of the Road Vehicles (Registration and Licensing) Regulation 2002 have been there since errr.......2002 is the legislation you are looking for that allows for the disclosure of keeper information.
https://www.legislation.gov.uk/uksi/2002/2742/regulation/27/made
Under Section 34 of the 1998 Data Protection Act there is an exemption to the disclosure of personal information if information is available to the public under an enactment. An enactment such as Regulations 27 and 28 of the Road Vehicles (Registration and Licensing) Regulation 2002.

I've had an email today from the KADOE person at the DVLA who explained the process; that they provide information to ATA members that operate within a code of practice. I've requested information on what happens when the requesting company is in violation of the ATA code of practice.
I've asked what safeguards are in place to prevent the DVLA issuing personal information to a private company that is not compliant, or whether the DVLA just take their word for it and hand information over on the assumption that these companies are fully compliant. That's most likely the case, and it's a bit dodgy given that they're giving addresses and names out on that basis!0 -

Yes, see the legislation I've quoted above or read this handy leaflet produced by the DVLA.

"Cresh" not a word I've come across, is it a slang word from a regional dialect?0 -
I predict this will all be a tick box exercise with the ICO satisfied as soon as the DVLA utter the words 'ATA' and 'reasonable cause' and the ICO will go away.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
