The small print signage and your gf's actual right for her and visitors to park there under her lease or tenancy agreement, were the main points to try, apart from the landowner authority issue.

The Judge asked you of you were OK with the signage and...surely not...you didn't grasp that olive branch?  The Judge was handing you the main defence point everyone uses - the signs.  Judges drop huge hints.  The signs were the key.

So sorry you lost.  at least you managed to get the added £60 removed (abuse of process).

  • Problem is I turned the flat upside down looking for the tenancy agreement. Of all things that could go missing eh? As for the signage it was all ok. At least it seems that way. There is a sign right next to where I park the car so couldn't really see a problem

The signs are never OK.  The Judge gave you a clue and you missed it.  The signs are ALWAYS to be disputed even if there is one near the car!  Sad that you lost but the signs are the contract = the very crux of every case.

  • I'll remember this one for next time. There will be a next time because I had another ticket several months after.  Haven't heard anything in a while but watch this space

    OK, good.  Get your revenge!

Maybe the next one will be struck out by using the new defence template and three appendices we are now suggesting on the template defence thread.  Or maybe you will see it off by looking at signage rules in the CoP and font sizes, and finding a copy of the lease agreement granting parking rights with no cost or permit obligations for visitors or residents.
