EU Rules for a UK Ltd Company?

Options
Purchased an item online, not suitable so emailed seller same day as delivery requesting cancellation.


Had a reply the following day stating no problem to return, however there would be a £20 admin/restocking fee.


Website stated:

"All orders cancelled after 24 hours are subject to a £20 administration fee"


They also mentioned in their email about cancelling that "[FONT=&quot]We are regulated by the EU Consumer Rights Act"[/FONT]

[FONT=&quot]Both the address on their website and the return address are in the UK.[/FONT]
[FONT=&quot]

[FONT=&quot]Any thoughts? Are they taking the rise or acting withiin the rules?

    UK company then they are bound by the UK Consumer Regulations not EU .

    Are you a consumer or a business?

    If you're a consumer then they're obliged by law to provide a full refund.
  • Yep 100% UK company registered on companies house, and consumer purchase, not for business.

    What is the name of the company? There have been one or two instances on here where consumers have purchased products from businesses who clearly state they are wholesalers who only sell to businesses.

    Unlikely I know but I just want to make certain assumptions aren't being made.

  • Not helpful when I'm trying to establish if they can charge £20 or not. Did not have much choice in company selection as no other vendor selling the item I purchased.

    Answer is not under UK laws see sticky .
    I would send a copy of the law to them and or a letter before action .

    Note they claim to be a UK retailer not a wholesaler nor an EU based non UK company .

    SECTION 18 - GOVERNING LAW

    These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of United Kingdom.

    They have a lot to learn about the distance selling laws in UK.

    Two directors are South African.

    Looks like a dropshipper adding a big markup to stuff bought via Amazon marketplace.

    Dodgy T&Cs.

    Office adress is rented from a virtual office agency. T&Cs say that return addresses will be given on request - presumably direct to the Amazon marketplace seller.

    Last accounts filed for the period up to November 2017 show assets of £333 liabilities of £2284.

    If this lot sold bargepoles I still wouldn't go anywhere near them.

    Lets assume that getting a CCJ will be pointless with no identifiable company assets.
