Move on. Thankfully your wife is better, your out of pocket expenses have been reimbursed and you’re home. Your insurance process worked. I don’t see a breach of duty of care, I see someone who has seen pound signs.

Your complaints about the care you received appear to be as follows:
- That you had to take a taxi to the hospital. In many countries ambulance services are chargeable. Did you speak to your insurers as to how to arrange transportation to the hospital?
- That the hospital claim that they weren't forewarned of your arrival. Given that there were few English speakers at the hospital it is possible that the cruise company did alert them but that no action was taken on the hospital end.
- That there were language issues and a rigmarole concerning making payment. Again, presumably your insurer would have been able to explain the process to you and it isn't unreasonable that the hospital ensured that it was going to receive payment before commencing treatment.
What could the cruise company have done to change the situation? Your wife was no longer in the care of their medical team - they advised that further tests be run at a hospital with either you or your insurer being responsible for arranging and paying for this. The only thing they could possibly have done would have been to send a crew member with you, who was Spanish speaking, to assist with translating. However, it is perfectly understandable that they chose not to offer such a service as any issues arising from their assistance could have rendered them legally liable and subject to litigation. Given your apparent desire to hold them in some way financially liable their reluctance to provide assistance away from the ship appears to be well founded.0 -

Playing devil's advocate here, how many Spanish speaking hospitals do we have in the UK?
Well I used to work in the NHS and I continually hear that the NHS would collapse without staff from the EU (some of whom speak Spanish) working in it.
I'm reasonably confident that a non-English speaking Spanish tourist would easily be understood in a London hospital.
But I'd be expecting the insurance company to be sorting all this out for me anyway, not the cruise company.0 -
However, I did pay £1403.22 to Princess Cruises for the two hours of medical tests and treatment before leaving their medical facility.
The question is does this payment constitute a contract?
Yes. It was a contract for the tests they conducted, and the results they delivered. It wasn't a contract for continued ongoing care or for the treatments or for them to actually care about you.(Although I could be wrong, I often am.)0
