Its legacy esa so she can receive sdp severe disability premium. U.c systems cant pay it......at the minute

It's not a case of UC systems can't pay it at the minute - it simply doesn’t exist under UC.

On this I disagree with Alice. There are no premiums in new style ESA (because it is contribution based) so it is not possible to get an SDP with new style ESA regardless of circumstances.

    Yes, quite right.

For some reason I had it (incorrectly) in my mind that it would be still be possible to get an income-based top up on a new style ESA claim.

Thanks, I have amended my post.

According to Gov.uk, new claims are still possible for Contribution based with Income related top up. This must surely include ability to claim the SDP, if there is an entitlement to this ?

I think it is worth asking ESA about this.
The comments I post are personal opinion. Always refer to official information sources before relying on internet forums. If you have a problem with any organisation, enter into their official complaints process at the earliest opportunity, as sometimes complaints have to be started within a certain time frame.

New claims for income based or contribution based ESA are still possible but only for those who are excluded from claiming UC. This is now just the group of people who already have a benefit in payment which includes an SDP. In the case of the OP's daughter it appears possible that her HB calculation should include the SDP and this would exclude her from UC and allow a claim for income based ESA as per my post #7.
