Management Company blocking Flat Sale

Hi,


Long story short.



Management company saying account is in arrears and won't provide a statement of the Service charge for the seller (was not part of the seller pack they provide).


They had asked for £700 sum in 7 days for unpaid Buildings insurance.

This was challenged and thrown out of court as they could provide no evidence the account is in arrears.
Yet they still refuse to provide the statement and are stil saying its in arrears.


The service charge of £125 per month + £50 being paid for future window planned work is fully paid and up to date.



We will lose the sale of the flat if they continue with this over the next 2-3 weeks as it does not look good or appetising to the buyers.


If we want to get any more info from them they now say its £95 a time in advance.


In reality he is being obstructive as he lost the case thorugh his own fault and was rude and discourteous to the judge during the hearing.


Got no idea how we go about getting the information we need from them without making it all drawn out and thus losing the sale of the flat which is now in week 12 with no chain on any side.


If I had hair it would be pulled out.

    Presumably when you when to court your solicitor counterclaimed for specific performance of the landlord's obligations to provide the relevant consent ? If not, ask them why not.

    Or pay up, and then attempt to claim afterwards. Which wont be ideal but it ought to mean you wont lose your sale.
  • Defended this claim with out solicitor they did not bring one either Judge even gave them time to find the evidence of which there is none.

    The reason we did not pay it is we don't have it and challenged why when up to date on service charge did we get a bill for unpaid Buidlings Insurance with no prior communication.

    Judge gave them every chance to find any evidence and nothing BUT they still think they can claim its in arrears. Next steps are us taking them to court IF the sale falls through due to their behaviour and my wife being left with huge debt as she has had to pay for the flat empty for 3 months.

    Why not have your solicitor write a letter to them asking for information required with suitable time frame and pointing out that you will seek damages if sale frustrated by non compliance.
