Re closure of business VAT refund

    Thanks for the registration number. Unfortunately the accounts ending September 2017 have yet to be filed. Did your accountant send you them?

    I am not sure they could be in the box of receipts I had back in which case they are in the loft.

    Can you tell me please what info you need and I will get my husband to have a look in the loft.

    the published accounts, ie: the balance sheet and specifically the accompanying notes to the balance sheet so that we can see what creditors and debtors the company had at closure.

    Really sorry I have had my accounts down from the loft but I only have a bag of receipts no set of accounts for 2017, I have a copy of VAT account from HM Revenue showing returns £978.12 payments £1913.12 credits £935

    I have a copy of a letter from HM Rev which the secretary at accountants copied me in after she wrote to them, which states VAT Repayment for my company
    Thank you for your letter of 15th October asking for the sum of £935 to be repaid to someone other than the registered name.
    As companies house shows .............................(name of my company) as dissolved on 2nd October 2018 we treat the funds to be bona vacantia (ownerless property) and as a matter of law we must transfer funds to the Crown at:
    BV Division
    PO Box 2119
    Croydon
    CR90 9QU

    For more information on Bona vacantia contact the above office they may charge you a fee to receive funds that we've passed to the Crown.

    This was sent to me from the business services department of my accountants with the following email

    Hi Val in reference to my email I have just copied you in on to HMRC, please find attached a copy of the letter we have received from them today.
    As frustrating as it is the time it is taking, at least we know something is happening about this somewhere!
    I'll let you know if I hear anything further.

    I''m sorry if I am a bit vague about all this but I have never done my accounts or VAT this has always been dealt with by the accountants, this is why I feel they are fully responsible for retrieving this refund for me as I wouldn't have a clue on this, they have always done the VAT and rang me when it is due with the amount to pay and to get my authorisation to take it from my bank account.

    I had a call from this secretary I think middle of 2018 saying she was really pleased to inform me I had £935 refund but since then I have got nowhere this particular lady left the company and nothing seems to have been done.


    I can only send my thanks to you all for trying to give me advice I have had more response from you all than I have had from my accountants.

    Can I just put you in the picture, I paid the accountants for everything connected with the sale of my business to the new owners, and for the closure of my business to finalising all the accounts, so why am i left with a VAT credit that was never retrieved but I was told by staff at the accountants that they were getting it back for me

    UPDATE:
    Last night I traced back my old emails from the accountants I found one dated 26/9
    from Liz to say she had spoken to the VAT office and a cheque had been sent to my old business address (what she had actually done was give them the wrong limited name ) it was similar to mine but obviously the cheque must have gone to the wrong address, the chap who had my shop let me have all the post he received that was mine as I know him,

    Anyway they cancelled the cheque as Liz told them I also had no business account any longer either;

    She advised me to that they needed to write to the third party repayment team to change the address and name in which the repayment would be made.

    She said she would do this on my behalf or I could do it myself but as I don't understand the system as I have never dealt with them also I pay the accountant to deal with my VAT I suggested she did this.

    On 20/12 I advised Liz that I hadn't heard anything more and was distressed at how long it was taking.

    Her reply back was that she had tried calling again on this date but after waiting 15 minutes she got cut off, she sent another email but unfortunately she was leaving the company the next day and it was being passed to another colleague this is where everything came to a standstill.

    Apparantly as I no longer had a business address this is why the money went to the Crown, I am so confused by all this, just don't know why it wasn't sorted before they dissolved the business;

    Okay, from what you've posted regarding the action taken by your accountants, it would appear the VAT was not offset against any other monies owed to HMRC. If it had, I assume they would have told you.

    If I was you, I'd now write to your accountants asking them a) why they dissolved the company knowing money was owed to it, b) why the final accounts haven't been submitted and c) why you haven't received a copy of them.

    The accounts would only be a couple of pages pages showing your profit or loss for the year and the balances the company owed or were owed at the end of September 2017. At the very least you should received an email asking you to approve them before submission. You should have received this every year before they submitted them to Companies House.

    Hello and thank you to all the kind people on this forum who gave me advice re my VAT refund,

    I have today managed to have an appointment with my accountant and from information I had from HMRC we are now going ahead with a Discretionary grant CB2 I have to fill in a form DG2 apparantly it will cost me £300 but to be honest I just want closure on this now and get on with my life so if anyone should have the same problems as me with funds going to the Crown I think this is your way to go
