Late payments...

I have an account currently managed by Lowell. It was purchased in June 2017.

Prior to it being sold there had been 4 late payments.

Since Lowell bought the debt, it’s been paid on time every month, but still updates as ‘late payment’.

I complained to them and they have had this response...

“I can see from our records we purchased the above account as a non-defaulted account from Express Gifts Limited on 28 June 2017, during this time we were informed by Express Gifts Limited that they were reporting the account as Statues ‘4’ on your credit file. This means you had four missed/late payments with them prior to our involvement unfortunately, we have a duty of care to report accurate information to the credit reference agencies, and we are unable to remove the missed/late markers.

To clarify, the missed/late payment marker would continue to report every month, this doesn’t mean you have missed or made late payments every month; it would shows that you previously had missed or made a late payment”

Is this correct? Reported late each month when the payments haven’t been late for two years?

I don’t want to refer to the ombudsman if this is actually correct, although it doesn’t seem right to me.

    Were the missed payments ever made up? Or are you permanently in arrears?

    If you're caught up, then it shouldn't be marked as late. If you're not, then it's correct, but you should ask if they would default it with a date that reflects when you were 6 months in arrears.
  • Completely caught up when the account was passed to Lowell.

    Lowell have confirmed there are no areas on the account, and that payments have been made monthly since owned by them.

    I am trying to remember how my file looked when I was on a DMP...I think that the late payment markers will continue to show, as you had never caught up with the arrears accrued before the DMP started. Then the account was sold with you still in 4 months arrears. Therefore, even though you are keeping up with your agreed payment plan with Lowell, the arrears still exist and need to be marked on the file for accuracy.


    I am only 60% on this as I cannot really remember accurately. It has been nearly 10 years since I had the same markers...maybe someone will come along with something more definite...you need the advice of a professional debt counsellor, and they hang out mostly on the DFW board...

    I would not worry too much about the late payment markers. The real toxic data on your file are the defaults and any AP markers that are the result of your DMP.

    Either way, if you are looking for a mortgage then a good mortgage broker should still be able to find you a lender, even with the negative markers on your file. :)
