Neighbour has taken over public alleyway

    Hi all, sorry for the very late update.

    The situation has still not been resolved. We have tried to talk to the neighbours but they continue to take over the alleyway and attach more car repair equipment and now a roof to the side of the our garage (our relative's garage).

    We are not sure how to proceed without causing relations to deteriorate even further. The issue is worsened due to our relative being terminally ill and too frightened of what her neighbours might do if we pursue the legal route.

    What did the local Ramblers Association say?

    What did the council say about the property being used as business premises?

    Have you identified the owner of the alley? Or determined it is public highway? Or council owned?

    Is the roof now joined onto your property? Is this a trespass? Was a Party Wall agreement put in place or did you just allow this to happen?

    Ultimately there are 3 options:
    1) do nothing
    2) pursuade someone else to take action (eg council, ramblers, tough guys from that nasty pub in the bad part of town)
    3) negotiate (apparantly tried and failed)
    4) take legal action yourself
    5) block the alley yourself so they cannot access it with their cars



    (I still can't count....)

    The person I spoke to at the council didn't know anything about the alleyway. We have since downloaded the plans for our relative's property and that of her neighbour. The plans clearly show the boundaries of the two houses does not include the public alleyway.

    Our relative is too frightened to formally report them to the council at the moment, so that makes further action a little tricky for us.

    The wooden board (shack-like) roof is now affixed to 'our' property over the public alleyway.

    Our current intention is to approach the neighbours to demand that any structures affixed to 'our' property be taken down as we need access to our garage to refurbish the wall that runs along the public alleyway, as we currently have to access to that wall any more.

    I use the term 'we' and 'our' in reference to our relative's property as she is too frightened to deal with this or to face the neighbours. So a few us will make the demand ourselves and be firm about it.

    Sounds like a good plan Evoke. Hope it works out. So sorry your poor relative is having to cope with this when they're so ill.

    You really need to find out who owns the alley. You've established who does not own it, but not who does!


    Your relatives need to bite the bullet. Even if they end up living with this, rather than dealing with it, it will become a nightmare in the future if/when they the property is sold........ 1st question any buyer will ask.......


    Given they are frightened, it's all the more reason to get a 3rd party involved. 'Ramblers' wassuggested I suspect half in jest, but you never know!


    But the council definately. Even if not from the point of view of blocking the alley, but from mis-use of a residential property for business purposes.

    If they've drilled into your relative's wall to affix this roof it's criminal damage. I'm afraid they need to get a grip of this situation as soon as possible because it's escalating as it is. The police, council and dare say it, the local paper, would all be on their side here - intimidating a terminally ill person is about as low as it gets.
