Hi everyone, hope someone can help me, not sure if this is in the right section, but here goes,
nov last year my neighbour had his roof replaced, and june this year i noticed where the 2 roofs join togther, the slates had slipped over time, i know now the roofing company just pushed the slates in, without securing them, some are damaged and a couple are missing, i went inside the attic and the underlayment where the 2 roofs join togther had been pulled out,
i went to my neighbor and told him, he said he would speak to the roofing company to sort it, i told him i would get my insurance company to look at it, they did and sent me a small report, stating it was due to poor workmanship by the company who did my neigbours roof,
i told my neighbor i thought he was responsilbe as he had hired them, i gave him a letter which listed all the problems i had with our roof, and a week later he sent me a letter stating that he was not accepting any responsiblity as he had not been on the roof and i should take it up with the roofing company,
for the last 3 months, i have written to them and phoned them many times, they just say they will phone back, but never do, i want to get the roof repaired now, by another company, and claim the cost back thru the small claims court, but who do i sue the neighbour or the roofing company ?
a friend told me to sue my neighbour as he has the majority of the responsibilty as they were his agents/contractor. i'm writing a final letter to post to my neighbour giving him 2wks to get the roof repaired or i will get a roofing company in and sue him for the costs..
anyone have any adivce ? this has been dragged out for so long now..
thanks
joe

afaik: you can sue him for the repair and he in turn, will have to sue the builder (or his own insurance) to recover his money.Get some gorm.0

thanks for the replies,
Andy, the thing is rain could be leaking in the roof, i've looked but not seen any thou, but its been 6 months now, and it seems, i'm not getting anywhere, the roofing company is a waste of time, the next door neighbour gave me their telephone number, i phoned them, and they wouldn't even tell me their address  , but i finally found the street they are on, they've just keep saying i'll phone you back, but never do, they agreed when i finally got a letter to them with photos of the state of the roof it needed repairing,,
i agree with you my neighbour should be chasing them, as i've not employed them, and he should be threatening to sue them not me,what do you think if i write a letter to my neighbour giving him 2 wks to get the roof fixed, using the same roofing company or another, or i'll take him to the small claims court, and get a couple of quotes and sue him for that amount + costs ??, the state of the roof where they join togther is really bad, i would say at least 10 slates have moved, and a couple are in the gutter !!, and it looks like a couple are even missing.
thanks again.0
