Egg - PPI Rejected Plevin Upheld

Options
I have received a letter today from Canada Square Operations, they have rejected my PPI complaint but refunding £244 due to Plevin. I intend to refer to the Ombudsman as they state -

"we do acknowledge that there may have been flaws in our sales process. However, despite this I am not persuaded that any of these failings would have affected your decision to take out the PPI policy"

My initial complaint was that I was not aware that PPI had been applied to the account. I've never bothered checking in all this time as I really did not think that I had it.

They state that it is clear that I had no other means of protecting my payments.

Two questions I guess....

1. Do I have a case to raise with the Ombudsman? Regardless of whether I had means to protect elsewhere or not, I was not aware that I had PPI - it should have been my decision to make.

2. Is there any way of working out what PPI was paid if the Plevin refund is £244?

You can complain, but your case is very weak, as you would have seen the PPI premium on every statement.

If you complain that you didnt know you had it, then that complaint reason is credible in the early months of paying it. Even a few years. However, the longer time goes on, the less credible it becomes. After all, it appeared on each monthly statement.

The FOS is not a consumer champion. It is there to act as an independent arbiter of complaints. So, you have had your response from Egg. What have you got to counter it?

    no.

You can accept the Plevin payment and still go to the FOS, they will reduce your payout by the Plevin amount if they agree with you

Sam Vimes' Boots Theory of Socioeconomic Unfairness:

People are rich because they spend less money. A poor man buys $10 boots that last a season or two before he's walking in wet shoes and has to buy another pair. A rich man buys $50 boots that are made better and give him 10 years of dry feet. The poor man has spent $100 over those 10 years and still has wet feet.
